What is Defamation of Character?

The term defamation of character is often used to describe accusations of slander, libel or both. Slander involves verbal derogatory statements, while libel involves written ones. In a court of law, the plaintiff pursuing the lawsuit would charge defamation of character to cover any form of false or damaging allegations.

Defamation of character is notoriously difficult to prove in court, although the actual effects can be quite evident and damaging. If a disgruntled customer of a restaurant tells numerous people that the head chef has AIDS, for example, sales for that restaurant could fall and the employee might lose his job or find it difficult to work. Because the customer's slanderous statement concerns a specific person and an unproven accusation, the chef may have a legitimate case of defamation of character.

The main problem with proving defamation of character is the protection of free speech guaranteed by the First Amendment. Courts generally agree that an opinion, no matter how malicious, is not the same as a stated fact. If the disgruntled customer had said "Don't eat at Joe's Cafe. I think the food is lousy and the chef is sick," then defamation of character would be difficult to prove. Other people can still form different opinions. Once the customer said "Don't eat at Joe's Cafe. I know the chef and he has AIDS," then a statement of fact has occurred and a claim of defamation of character can be pursued.

Another problem concerning defamation of character is the actual truth of the statement. Some may argue that in order for defamation of character to occur, the alleged victim actually has to have character to defame in the first place. Calling a known neighborhood bully a 'thug' in the local paper wouldn't qualify as defamation of character, because it isn't a statement against fact. The truth is, the truthfulness of the statement isn't always a factor in actual court proceedings. In our hypothetical case, the court would assume the chef does not in fact have AIDS and the defendant knew this at the time the statements were made.

Very few defamation of character lawsuits actually reach the level of a court trial. Many are settled privately, in order to avoid even more damage from publicity. Since actual damages must be demonstrated, some cases are dismissed because the statements or accusations do not rise to the level of actual slander or libel. Hurt feelings or a loss of social standing may not reach the legal definition of damages. What few defamation of character cases do reach the court system are usually local in nature, such as a city councilman suing his local newspaper for implying he accepted a bribe.

In our case of the chef and the disgruntled customer, damages could most likely be demonstrated by restaurant sales records and testimony from other customers who heard the slanderous statements firsthand. Even if medical tests revealed that the chef did indeed have a medical condition, that fact alone would not mitigate the customer's obvious malicious intent. The customer was not working in the public's best interest at the time. Under these circumstances, the court would most likely find in favor of the plaintiff and order the defendant to pay punitive damages.

This is generally the same legal mechanism which allows celebrities to successfully sue tabloid publications. A truthful but malicious statement can still be considered defamation of character under the right circumstances.

I work with people that are spreading rumors about me being gay. I'm harassed on a daily basis because these people really believe that I'm gay. I get called names such as dyke, freak, gay ass and that hoe is gay. These people don't know me and the person that is spreading this rumor is someone that I have never even talked to. My 13 year old son has been bullied at school for the last two years, and the parents of those bullies are supporting them bullying my son and are complaining to the class teacher and school director.

One day, my son was showing his classmates a video about a commercial, and one of the girls accused my son secretly to teacher that my son was showing them sexual material. We have spoken to other parents and it was confirmed that my son is innocent and has been framed by the students who have been bullying my son.

He is getting now dismissed from school and my son is extremely hurt and shocked. Can we sue the school, or his teacher for spreading this story although it turned out to be fake?

I am a happily married military wife. I recently found out that this gentleman (I say that very loosely) in my neighborhood has been attending some of the college age parties telling anyone that will listen to him how he has been with me sexually, with graphic details to include very demeaning acts that he's supposedly done to me.

I barely know this individual. I live in a military neighborhood off post. My husband is high ranking and I represent him. I value my reputation and until now have never questioned what others were thinking.

I have investigated and since heard from a total of four people with similar statements about what he has said about me. Obviously, this falls under defamation of character. Can I sue this individual?

My ex did some really mean things to me, some physical. He's telling people that I'm lying about it all. He's posting on Facebook that I'm bipolar, unstable, a habitual liar and is telling people that I broke into his workplace and tried to kill him so people will think I'm a crazy homicidal maniac and won't believe me.

I'm catherine from the philippines, and my grade school cousin was tagged by the school as a bully, which he doesn't deserve. He was hit by his bigger classmate and was brought to the hospital for 16 stitches in the mouth.

The parents of the child who hit my cousin said that if their child was not provoked, then their child wouldn't have had hit my cousin, and that they will not shoulder the full expenses at the hospital. we need help against cps in California. they lied and made false accusations and made up reports violating civil rights and discrimination due to me being a transgender m2f and being lesbians removed our rights and didn't even get to start some stuff for the so-called case plan due to their funding problems.

they refused to extend time over the 18 months from when they took our son and it's not our fault due to county not having funding to pay the places who help you with your case plan so cps said it's our fault that we weren't following the case plan and said we should pay out of pocket. but how could we due to the hardship they caused and us not having a fair trial due to my wife’s family lawyer forwarding her conversations to the cps worker?

we have lots of proof of wrongdoing on us and need help to find a lawyer to take the case to get our son and file a lawsuit on violation of rights, post traumatic stress, and the list can go on for the lawsuit we wish to file but can't find a lawyer to help. all the ones we have contacted say that county is too corrupt. they said don't give up and keep looking, so please help.

@anon198497: The new girlfriend might have a harassment case against you, if you kept calling her, or threatened her. She could probably even get a restraining order on you, for that reason.

However, she's just flapping her gums if she thinks she has a defamation case against you. Defamation, by its very nature, means that the statements were made in a public arena, and somehow damaged her career, reputation, etc. Screaming at someone over the phone is not defamation. It's called having an argument. You didn't make the statements on a social networking site, did you, or in the newspaper or something, right? If it was strictly over the phone, then it's not defamation because it was never stated in public.

If you have personal property at his home, call the local law enforcement and have an officer meet you at his house, pick up your things, tell the cheating so-and-so and his new girlfriend where to put it, leave and don't look back. This is a golden opportunity to get rid of some dead weight in your life. Take it and move on to bigger and better things.

My fiance and I are in a bitter custody battle for his daughter, whom he already had custody of for two years prior to this. Because of false accusations, the child's mother brought against us (which has since came back unfounded from dcyf), she has been withholding her from us and we got a temporary court order for supervised visits.

At one of our visits, the "supervisor," who is the mother's sister-in-law, is claiming we tried getting in the car and kidnapping her, and she has since written a two-page sworn affidavit stating this. It is absolutely false and we are in the process of getting the tapes from the place where we had our visit. When it is all said and done, can we file for defamation of character?

Be aware that our laws are always developing and this is a targeted issue in companies (see online "workplace bullying"). Obviously, bullying doesn't stop in high school.

My boyfriend's mother is accusing me of abusing my boyfriend's son, because he told her that I did, which I have never done! He is 4 and lies all the time about other people too. My wife cheated with my boss and vice versa. Anyway, I found out of course, kept working for him for 2twodays after I knew the truth of what had happened. A fellow colleague asked me what was wrong, so I told the truth.

I have since resigned from the job. I had to give a reason for quitting and I told what had happened to my other superior.

Since leaving the job, my ex-boss has found out that I told other work colleagues, and has threatened me with defamation of character, after destroying my family, making me pick up the broken pieces and putting the future of my kids at risk.

Do I have any reason for concern? I have not lied in any way about the situation. I have not slandered him, just disclosed some facts.

I work for a private kindergarten in Munich and one of my coworkers told the director that I have been coming to work high on drugs. This is absolutely not true and came as a complete shock because until I was confronted by the director, I had no idea anyone even had a problem with me.

During the confrontation with the director, she informed me that I am being fired, not for coming to work high, but because I am planing to quit my job at the end of the summer to move back to Canada to get married. She said that she can't prove that I'm coming to work high but I think she believed me when I denied it and was very clear in her point that she is not firing me for this reason. However, she refused to tell me who made this accusation so now I have to work there for the next six weeks with someone who has said such awful things about me and I don't know who.

I would like to confront this person and make sure they know that it is not okay to lie about someone like that with the intention of getting them fired. Is it possible within my rights to know who? Can I use the threat of legal action to demand that they tell me? Any advice would be much appreciated.

I don't know where to start, really. First of all, I have had a couple of run ins with a neighbor who has, after the run ins, called social services and falsely accused me of neglecting my children. Social services have been to visit a couple of times after these false reports and saw that everything is fine and these reports must be malicious. Anyway, recently I have started to talk to this neighbor again and everything seemed to be fine until last week when I went away for a few days and my partner was here looking after my children. he went to the neighbor's house and asked her if she had any antivirus software we could borrow for our computer and she came to have a look at our computer and had a coffee and left. Now I have found out that she has told neighbours that my partner sexually harassed her while she was here. She told the neighbours that she had reported him to the police and he was being arrested for sexual harassment.

After my partner and I had been told about what she had said, I asked my partner what had happened and he said nothing had happened, and she only looked at the computer and had a coffee and left and he doesn't understand where all this has come from. So, we went to the police to ask them if they could do anything to resolve this matter. The police said there was nothing they could do about it and we should seek legal advice, and then we asked if there had been a complaint of sexual harassment made against him and they said they had no record of a complaint against him. So, we left and came home to discuss what we should do and my son has come home from school and said that her son has been telling people at school that my partner had raped his mum. My family and I are really upset about these false rumours and I just thought I would write on here for a bit of advice. Any advice would be much appreciated.

I was recently fired over an anonymous phone call stating I by name made a inappropriate remark toward a customer. I was thought guilty from the get go, and i had to explain and defend myself against the claim. No name tag or any clothing associating me to the company i was named while training at a fellow store, while being supervised the entire time by the store manager.

No further information was given to me, even with the store manager's statement regarding my behavior while visiting as "professional". There are no witnesses to the accusations, nor is anyone willing to step forward to substantiate the claim. do i have the right to seek legal help regarding the financial turmoil this has caused me?

I posted a while back about a situation where i was slandered all over a casino, and it still hasn't stopped. I still get treated very terribly and followed around the casino, so i took someone's advice, and contacted the General Manager to lay it out, just what happened. It's been five days, and not one peep.

I can understand if they don't want the responsibility of the situation, and could easily have said as much, that it was a 'personal' thing and they are sorry but their employees are just doing what they are taught, etc. But nothing. Stonewalled, which makes me wonder if they are afraid?

I told them all I wanted was an apology. Not a word, Should I just forget about it, since I've aired it all out to them? I just don't get why nothing not even a 'sorry it's our policies' etc. Thanks. this is a great site.

I recently resigned from my job because the working conditions were unbearable. In the last month, three employees have left the company. I am thinking of contacting the Board of Directors to let them know what is happening. The Board has no clue about the dysfunction of the organization. No staff member was allowed to contact the Board for any reason, which I thought was ridiculous. It seems that the reason is because the executive director does not want the Board knowing how messed up the company is.

My question is: Would it be considered defamation of character if I put in a complaint to the Board of Directors? I want them to know that the executive director is not fulfilling the organization's mission and the working conditions are horrible.

I wanted to walk away, but then the more and more I think about the situation, the more I think about the harm she causes to the company and more importantly, the public. It is a private non-profit organization I worked for that is suppose to be providing services to the public with some federal funding. Please advise.

In September 2010, I was terminated from my employer. The reason was my supervisor and HR told me I was accused of accepting a $20 tip from one of the residents for doing extra laundry for that person. I worked in an Independent and Assisted living facility for the elderly.

On that day, I was called into the office and as I walked in, I was told by my supervisor that I was accused of accepting a tip, which was against the policy, and I was being placed on an unpaid suspension until they did their fact-finding mission. I told them I did not accept any tip of any kind because I knew it was against the policy and furthermore, I would not do anything to put my job in danger.

I had worked with the elderly for over 10 years and I had been there at that company a little over four years. My supervisor and HR did not follow the policy in the handbook at all. I did not receive any oral, verbal or written warning about this. In the policy book, it said if anyone is terminated or put on suspension, they were to leave the premises right then, and that's what I did. The next day I received a letter that I was terminated because I got angry and upset and I left.

I think anyone would have been angry and upset when they are accused of doing something that they did not do, especially when they follow the rules, but the company did not follow their own written rules. The HR person also said in the letter that if I filed unemployment they would deny it.

Well, I filed it anyway, and of course we had to have a conference 3-way call between myself, my employer and the unemployment office to get the facts over a $20 tip. After the phone call, come to find out there was nothing in my employee file against me that was negative, no written statements and no witnesses. It was all based on hearsay and they had no evidence that I had done anything wrong. I would never hurt any of those residents financially, and any one of them would tell anyone that.

I treated each and every one of them with respect and dignity and they deserve it. I looked at each and every one of them as if they could have been my mom, dad, grandmother or grandfather.

I went to apply at many different places that all seemed to be interested in my work history and when the references came back, I would call to check on the employment and all of a sudden these places were not hiring. I think they put vinegar in the fly ointment. I can't seem to be hired anywhere now.

Everywhere that I have worked I have always been voted for either employee of the month, employee of the quarter and employee of the year. It sounds like I was set up somewhere along the line.

In degrading a specific stereotype that is extremely obvious, isn't there a responsibility there in showing or teaching the public of all ages that a particular type of man is less than any another man? And if so, who and how many companies are liable for allowing to be taught to millions of viewers that this type of man is less than any another? Isn't that perhaps sabotaging a person's opportunity of first impressions when it should be judged on skills and not looks in the job search?

I mean, you see something enough times and you subconsciously begin to believe it and people act on that because its broadcasted all over the TV and internet. Perhaps defamation of character based on stereotyping? This could be very lucrative!

I sell products online for a small business, recently a customer ordered one of our products and he claimed that the item was damaged in shipment, he placed another order for the same item and he told us he will file a claim with the carrier for the damage on the first item.

We shipped the second order and the carrier paid him partial damage for the first order and they did not pick up the item up since it was not complete damage, now the customer decided to use the first item since the damage was minor (scratches) but the problem he has two identical products and decided that he does not need the second one.

He called us and claimed that the second item arrived with a scratch/dent and it was poorly fixed before it was shipped and he does not want it, the pictures he sent us does not show any thing, we told him he will be responsible for the shipping both ways if he want to return it, he refused that and file a claim with the same carrier for the damage and called his credit card and file a chargeback, the carrier paid him again for partial damage and his credit card put the money back on his credit card.

Now he has our product (which he did not pay for) and the claim money from the carrier.

He is a partner in one of the large companies worldwide, and we are planning to send emails to his colleagues telling them what a crook he is and include evidence from the carrier and the credit card company showing that he filed a claim for an item he did not pay for and he refuses to send it to us. Is this a defamation of character?

An ex employee who was fired filed for unemployment. The issue is that in the reason for separation she stated "due to harassment and personal persecution directed at me by my supervisor." She also went on to state that I had employees threatened not to disclose the relationship of other workers in my department that were blood relatives.

None of this was true. Because of the lies and false accusations, I was not eligible to be switched from a 1099 to a W2, i was not given the promotion I was promised and was not given my commission check as a result of this.

Can I sue for defamation of character as her lies and false accusations affected my occupation and salary and credibility as department manager?

I work for a business in the automotive industry. my boss left a different company to start his own and we are now more successful then the business he used to work at.

my boss has never had a harsh word to say about his previous business, but recently one of our customers went to the shop my boss used to work at and used the customer bathroom. Our company name is on a sticker in the toilet for their customers to urinate and defecate on.

I am a person who has been convicted of a sexual offense/Crime om 1998. I have successfully completed my 10 year registry requirements and have been released from the registry.

Now, after that fact, a DHS worker has told my wife that she married a sex offender, accompanied by accusations that by doing so has placed her kids in danger and is claiming that she (my wife) doesn't see the severity of my situation as a sex offender.

Would I have a case of defamation of character? The simple fact that I was convicted of a sexual offense 13 years ago does not make me a sex offender today. And would that also be defamation of character towards my wife by the DHS for their comments over her marrying me?

I Worked for a large New England retail store. I injured myself at work. I went through all the workers comp and physical therapy.

When I went back, the whole store had known about the situation and was claiming i didn't hurt myself on the clock or in the store. The store manager even accused me of not hurting myself in work and the workers comp claim was false.

I talked to the asst manager and told him i wanted to quit. He told me that I should talk to the store manager. When I made it in he told me that he'd give me time to think about keeping the job. Didn't give me any options.

I went back less than a week later to talk to him about keeping my job. He told me that it was too late and had already given my job to someone else. I've spoken to a few people and am wondering if i have any legal grounds.

For 5 years i have been employed by Rite aid pharmacy, but i was given a job opportunity that i just couldn't refuse. Well i went about this the correct way by putting in my 2 weeks notice with rite aid and helped them train new techs to fill my position. One of the tech that worked for rite aid had already gotten a job with this new pharmacy so i thought everything would be fine. on oct 1, when i was suppose to start training, i went to the new job and the manager tells me that he can't hire me because of something someone said. The lady that i worked with at rite aid told the manager that she and i had a dispute of some sort and she would rather me not work there. So keep in mind i no longer had a job with rite aid because this guy told me that he would pay me more and i could start on that friday.

First things first. I had social services involved with me and my children because of a lie by a neighbor. Secondly, they had to come out a second time because someone had written an anon letter to them which states as follows.

"I am writing to you regarding a certain woman that you are aware of. Her name i believe is ****** and lives in ******* ******** ******** area. The other day while very drunk she was seen carrying her youngest in her arms screaming and shouting obscenities at another woman. This was quite late at night too. This was causing a lot of stress not only to the child but to other tenants in the area." Letter ends.

It has been found out by social services as well as by me that these are malicious lies, but i am aware of who did this after i took my children from a friend's house while she decided she was going to have her two male friends around while my children were sleeping there because she wanted some weed and they started to smoke it around my kids.

I had a go at her, took my kids and called a friend to come and pick me up. This was two weeks after the first allegation and funnily enough, this letter full of lies was sent out to the ss department a couple of days after i had removed my children from danger from her house.

Now i know for certain that this is the person who did this as she lost her own children due to drugs and alcohol.

Ss are 100 percent in support of me and have closed my case as they have also found out that this is malicious. With what has been written in the letter, i want to sue this woman for defamation of character because i nearly lost my children because of her lies. Does this cover defamation of character and do i have a case?

I have lost custody of my daughter to my ex, who has lied about who i am. he accused me of wrongful things and tried to have protective orders against me, called cps, called child safety on me. Everything has been closed, but i still don't have custody because he doesn't stop lying about me.

my former boss called the cops on me while i was working for her, accusing me of stealing money and check books, then when i quit she called the cops on me accusing me of stealing more things. i never stole anything from her.

Now i have a new job and my former boss has told my new boss that I'm a thief and the police are investigating me, which is a lie. so do i have a legal court case i can pursue? i just want her off my back and she just won't leave me alone.

@Anon113340: No, it is not defamation of character. Publishing anything that is public record, as long as the information is accurate, is not defamation. He can tell the neighbor he will have him arrested for harassment if he doesn't leave him alone, but the media doesn't need permission to publish anything that is a matter of public record.

To whom it may concern: Here are two situations.

First: One of my friends got arrested for crimes of nature at his job. The person was arrested and taken to the county jail the person was booked and then released on unsecured bail.

We all know there is a county website and your information is a matter of public record, but come to find out there is a weekly paper -- not the public newspaper -- but another weekly circular like you get when you get sale ads, etc. Come to find out the arrest was listed in the paper with a mugshot of my friend, without any permission or notice of this situation.

Second part of this: Since my friend lives in a cookie cutter town, the neighbors of course looked at the paper and a neighbor comes over and says slanderous words and is putting my friend down and saying just rude comments. Would this be a case of defamation of character?

Here is my issue. I work for one of the largest retail stores in the world. About five years ago we had a new district manager change over and we got a new one. When she came into the store she came over to my area and introduced herself to me. Pretty nice lady, or so it seemed, at the time, of course.

She told me that she wanted me to do a store tour with her later that afternoon. When she did the tour i was on lunch so i missed it. From that day she would walk by my department and talk down to me, she would tell me that she didn't think that i could do my job right. she would tell me that she didn't think that i understood what a good manager is.

So one day about a year later, she came into the store and came over to my area and i turned and said hi. She then exclaimed "Can you tell me why your area looks like bleep!" I was baffled and I then started to defend myself and give it to her back, but I didn't swear or raise my voice.

I started to cry and told her all the problems i was having with the managers in the building on account of how she was treating me. She then comes down and spoke to me and i thought that all my issues were clear with her.

The next day she came into the store and I was in my department, but i was in another aisle and she didn't see me. I overheard her say "is she in a better mood today?" and her and the management team all laughed. i thought, nice! i thought my issues were gone and they had just started. Literally!

So the district manager continued to come into the store and continued to ridicule me to where the whole store was talking about it. Then the managers started to tell me when she would be coming in the building and they would say, "She is coming today and you know that she doesn't like you so you need to do your job harder than anyone else because she will always come over to your area because she hates you." I thought, wow -- how am i going to get out of this hell?

So for the next year or two i tried and tried to get out of her sight. i laid low and worked so hard in my department but she still came in and ridiculed me.

I worked so hard that i wanted to go into upper management so i put in an application one day upon the recommendation of a few managers and my store manager. I went to the interview and it went so well and i was on the ball. So now all i had to wait for was for her to approve it. Of course she turned me down flat!

So i then decided that i was going to move to a smaller department where i could stay under her radar and just do my job. No worries, right?

Nope, the same stuff happens in the department I'm in now and the funny part is that the girl that took over the department that i used to have runs it like i did before and she never goes over there and yells at her. But she comes over to mine and finds something every time.

So here i am now in present day and i am still going through the same stuff with this woman. I've been at this company for seven years and i still apparently don't know what I'm doing. I'm horrible.

I was asked to go to the overnight shift and reset an area. i said yes, i would do it for a week. While i was on overnights i was told that i had to stay another week. then the week after that was a scheduled vacation. so three weeks and my department was neglected.

i went back to days and found out that she walked my area while i was on nights and tore me apart. i was told that my department was the worst in the store and i need to step up my game. I wasn't there for three weeks and they had no one covering my department while i was gone. Sounds like they tried to set me up for failure. i think so.

So now i am scared every day that she is going to come in to work. my anxiety is up and down and i am leaving crying from work and my husband says i should quit, but i feel if i quit then she has won.

Do i have any case at all? I'm so sick of feeling like this and with the economy like it is, it's not like i will find something else.

I served as a union shop steward in a government agency. While representing a coworker in a grievance meeting, I questioned the truthfulness of statements made by management.

The following day, the director of the agency called a former agency employee who was a social networking friend of mine. She told the former employee that I had mental problems and that I was spending too much time on union business.

She asked the former coworker to access my social network account and print out any posts I had made regarding doing union work. The former coworker refused. The following day, the director called her again and left her a voicemail message stating that people in the office were nervous about my stability.

After I filed a complaint with the HR department, my ID badge was disabled and I was no longer allowed in the office without a management escort. Staff were instructed not to allow me to enter the building and to call a manager if I came in.

I have depression and ADHD I do see a therapist but I am not unstable. I have been with the agency for 14 years and have never received an unsatisfactory performance review or a disciplinary action.

I believe that management is trying to damage my reputation within the agency and with my coworkers by suggesting that I mentally unstable and dangerous. I feel that there may be irreparable harm to my career and I may not be able to return. Is this defamation of character? What can I do?

I helped a friend who needed a place to stay and a babysitter. i babysat when she went to work and even when she came home as well as her days off. We got into a little altercation and i asked her to leave my house where she was living rent free.

She was so disgruntled she called the police on me and said that i was having domestic problems and the kids were in danger, but it was a lie. The police came checked the house and the kids and found everything was fine.

All right so here's my case.

I worked for a theatre which I will not specify for more than a year. I became an assistant manager a few months before quitting. OK so favoritism got out of hand with another employee who knew how to manipulate the other managers which in turn knew how to manipulate the GM. The GM is very gullible.

Well anyway, they fired the projection manager (who had been working there for more than a decade) for personal reasons triggered by the employee favored in there. That same day, most of the projection staff quit because they felt it wasn't fair that they did that. The day after, I quit after finding out that my shift was already covered the previous night. In other words, the GM was going to fire me so I beat her to the punch. So that morning before anyone was in the building, I drove up there, left my keys, badges, and letter of resignation on her desk and that was that.

So now, I and a few other ex projection employees are being interrogated and are suspects of "vandalizing" the projection booth because they had a lot of problems with the projectors that day. Take into consideration that the people currently running the projectors do not have enough experience to fix/troubleshoot projector problems.

I did not touch a single projector in that theatre that morning. All I did was quit. All I did was quit. And now I'm a suspect?

If this case does go to court, can I counter sue for defamation of character?

I reached an agreement with an NYC business on selling domains. He agreed to the terms, paid for the domains, but never initiated the transfer. As time passed, he asked me to do some random project that I have no experience in.

My friend performed the work. The owner never paid for the design. He took offense at the design, saying it was crap. The main problem I'm having is that he wants his money back for all the domains that he paid for. He has threatened me in an e-mail, stating that once I graduate from school, he will file a complaint so that I'm indexed in Google, and will not find any employment.

I refuse to refund a deal that he accepted and agreed on. He never initiated the transfer. I kept sending messages to push the transfer, and even offered to do the transfer.

to anonymous post #201: If you can prove that you lost wages (or your car, etc), you lost your job, or something like that, then i think you can sue your 'friend' for defamation (and possibly the business owner).

Otherwise, you can probably sue them for pain-and-suffering or something similar? I guess that would depend on what state you live in.

But if you can prove that your 'friend' knowingly lied, used his authority to lie to you in order to commit a crime, and the business owner knowingly covered up the actions, you can probably report the incident to court officials and possibly have their license and agreement with the court revoked. i would look into that. call a lawyer.

Here is my situation. I was arrested and I had a friend who worked at a bail bond company. Well he told my girlfriend that the owner demanded I turn my leased car over. Well he lied and just used it for personal use.

When I got out he said that if I didn't give him the car he would have my bail revoked and send me to jail( some friend I know). Well I confronted the owner and he said he didn't know anything about it. I have text messages with the threats too. Well since I called his boss he got mad. He told the owner that I got some girl from out of state pregnant and she removed her collateral from my bail. She also told him the plan of us leaving the country for Canada.

Well the owner asked me down to the office to discuss some of the things his employee did. He said be there at x time so the employee isn't there. Well he lied and set it up so we both came at same time. He agreed with me on the phone and said the employee would be fired, but that was a lie. After going through all the facts the owner said that the employee called his insurance company and canceled his mother who was a cosigner of mine.

The owner said I needed two cosigners to replace her. He gave me one hour. I got one to come down and he spoke to him outside in Spanish. He told him that I was lying to everyone and that I had another girl who I got pregnant etc. Well he took me back in to jail. He said that I would be out as soon as my girlfriend got me two cosigners.

Well when she called he said that he didn't want to get involved, but proceeded to tell her that I had a woman come in who was pregnant with my child etc. He never bothered to confirm that the story was true. He just listened to his employee who he knew was mad at me. He also said that I offered him drugs as a bail payment.

Turns out that was what his employee told him, but he said it as though I told him personally. He also told my lawyer's office the same stories. He said it wasn't his fault, it was his employees, but he is the owner and responsible for their actions.

The employee also called me boss while working and told him the same stories trying to get me fired. Do I have a case against them? Thanks

How about this: can organizations keep "secret" files on their members? Specifically the Boy Scouts of America. It has come to light that they do in fact keep secret files on their membership. The BSA has allegedly dismissed members based on their secret files but choose not to reveal to the dismissed member why they were dismissed.

The BSA recently lost a case concerning child abuse by a volunteer leader in Portland, Oregon. The court ordered the BSA to release their secret files concerning child abuse. The plaintiff won his case against the BSA. The BSA was found liable for $20 million in damages. Now journalists are seeking these secret files from the BSA (per the washington post)

People have been commenting on a Scouting forum concerning this issue.

It has been confirmed that the BSA will dismiss volunteers based on hearsay even if the accused did nothing wrong.

Is it lawful for such an organization such as the BSA to have "secret" files on individuals? If secret files exist on individuals, could that be considered libel?

An employment agency puts a "No hire" on someone who never came into their establishment to take a U.A. and puts a document saying otherwise in his file, the end result being that he is now unhirable by certain companies because he had an illegal toxin in his urine that he never got tested to see if he had.

Could this still be seen as defamation of character as now it is posted through that company that he cannot be hired because of an error that they made? As it was another person's U.A. that is being named as his.

Hoping someone can answer my question -

I will get to my question, but first I must provide some background. Forgive me if I am long-winded.

My family is military and living overseas in Germany. My son is 17 years old, and the girl he was dating is 17. My son is diagnosed with ADHD and clinical depression, and is a mild cutter. I use the term mild because they would probably be classified more as deep scratches and it has never been anything that required stitches, or even medical attention.

He has been under the care of a psychiatrist since kindergarten, and is on medication. Absolutely not violent or aggressive, and hurting a child or women goes against everything he believes in. He is also extremely smart, scoring 138 on his most recent WAIS IV test.

Now for what happened: his girlfriend’s friend had drawn a picture of a broken heart on her back, with little designs around it. She begged my son to trace the design with a razor blade, so that it would scar it on her. Scarification is the new tattoo from what I am told.

Well my son did not want to do it, and on their hour bus ride to and from school they wrote back and forth about it in his notebook, which he kept. My son finally did it for her as best he could, before saying he couldn't do it anymore, and then three days later she went to the school counselor and said my son locked her in a room, held her down, and cut her back up. They charged him with aggravated assault, and he was removed from school. In less than 48 hours he was proven innocent by all of the notebooks he had of them writing back and forth, which showed her begging him, as well as many comments such as “pain and blood is the only thing that turns me on.” Plus, she sent my son a letter saying it was not her fault that she had to lie and she knew he would be let off the hook, which we found out later she walked in of her own accord to tell this story to the counselor.

She asked my son to see him about a week later and he recorded their conversation with her apologizing for the lies, and saying she did not know why she lies all the time. Seems to me to be pure attention seeking. Even though the investigators have closed it and he is innocent, JAG has to review and sign off on it, which can take months because they are backlogged right now.

My son was not allowed to return to school, and after the way school officials treated him, as if he were guilty even after the investigation, he has decided to quit school completely. The girl has not had to miss a day of school, and to this day still has not admitted to the school, the military police, the other kids at school, or her parents that it was all a lie.

She walked around post with a couple of her friends as “bodyguards” and everyone making all over her with the poor, pitiful you. She gave my son a letter with all the threats people were making against him and said she was sorry about it all but she thought that he should know that he wasn't safe anymore, even though no one has ever messed with him. She has continued to spread lies about my son, such as telling people my son wants to rape her, and of course his friends come right back and tell him and the girl always denies saying it.

The only reason the other kids know the charges were a lie is because my son’s friends have made sure that everyone knows. The girl’s father is military, but her mother is a German national and works as a gate guard at our post. The girl works on post at the commissary.

Due to this girl's lies my son has quit school, is getting a GED, is glared at coming through the gates by the guards, and he no longer feels comfortable going to the commissary because she is there.

Finally my question. I know after JAG signs off, they can charge her with filing a false police report, but would this also be defamation of character and considering the impact, would this be worth pursuing?

So my former employer terminated me for "going to the bathroom" and never returning. I went to the emergency room, not the bathroom, but I guess the manager on duty, whose first language is not English like all of the managers there, misunderstood me somehow.

The GM terminated me on the above grounds even though I have proof I went to the ER that day and that was why I didn't return to work. I have since learned that the GM told lies about my termination to other coworkers.

Good grief! Assuming she's being truthful, she's 18, pregnant and doesn't know who the father is! What does this tell you about her? She's not doing anything but showing the world how stupid and immature she is.

My advice would be to stay strictly away from her, and set your Facebook profile to "private" so only your friends can see it and write on your wall. You can also delete everything she's written, and I would suggest you do it.

As tempting as it is to go and smash her idiot little face in, you're an adult. Be the grown up and don't respond to her. Don't even dignify any of her crap with a response. She doesn't deserve it, and when you get in the arena with her, all you're doing is making her feel important. She's important enough to get under your skin. Now, is that what you want? I would like to know what your take on this is. I broke up with my ex over six years ago. he is 31 and his current girlfriend is 18.

Now last week they were separated for whatever reason. She hacked in to his facebook and changed all of his passwords so he could not access it. He and I were friends on Facebook. I knew him five years before and we dated for four years and been friends for the last six years.

So anyway, she wrote all these nasty things on my wall. I cannot have children and she was laughing about it in my face. I just recently started to see a doctor to see what my options were, and she is currently pregnant right now with a child and unsure of the father.

I have a great career, I have graduated college with honors and am successful. So I inquired with the cops and they said it is to hard to prove. When it out right says haha I am pregnant and you can't have kids. Was I just talking to the wrong cops? I also said to the cops, well if it is too hard to prove and she gets her butt kicked, i can't be charged because it is too hard to prove. They said do what you need to do. Now what are my options? Was I talking to the wrong cops or do I take matters in to my own hands and kick her butt and take my chances? She wrote 27 messages back to back while I was at work. I was pulled over and got out of my vehicle and placed in hand cuffs. I was placed in a back of a cop car and told i need to come clean. I was accused of saying something to a little girl and then the mom supposed confronted me and i left the store.

The cops automatically assumed it was me and i argued and told them to go review the tapes at walmart. I believe the people who misidentified me or made false accusations should be held responsible for this.

My wife and I are going through a court case against my mother as she is trying to get our daughter. she keeps telling loads of lies about us to keep it going back to court. all of her lies are all documented in court paperwork and this has been going on for two years.

she says we are drug users. we all had drug and alcohol tests and only her test proved positive. she still claims we are using drugs which we don't.

I work in a power plant and as the control room operator am responsible for the environmental emissions from the boilers.

Recently one of the boilers I was operating experienced an emissions excursion in that it polluted in excess of the permitted limit. I filled out the required exceedence report which is forwarded through management and the environmental coordinator to the state.

I was informed by several co-workers they had been questioned by management as part of an investigation into the exceedence as to whether the overhead lighting in the control room was off.

Another worker stated they had been told I had been asleep and induced the exceedence by interrupting the fuel feed to the unit. There was no mention in my signed statement to the regulatory body of interruption of fuel feed as that was not the cause.

I am soon to attend a disciplinary meeting with management and could possibly be terminated from a job in which I earn over $100,000 a year. Even if not disciplined at this time, the fact that my signed statement was assumed to be false makes my position untenable. Do I have a defamation case? The overhead lighting was off but I was not alone in the room and not asleep.

The lights were off because I had complained of improper lighting above the computer screens causing eye strain and headaches. I had also requested modifications to the lighting configuration, anti glare shields on the screens, and anti-glare glasses for all the control room operators and was denied.

The Electrical Superintendent and Safety director both have said, "If the lights bother you, turn them off."

I was arrested and placed in jail overnight and was forced to sell my guns for bail money due to a son-in law making a statement to police which was false. In the end I talked to the prosecuting attorney and he dropped the charges. It ended up costing me my job and $1500.00 dollars. Could I sue for this amount or more?

I am a security guard who was removed from my site after more than three years of working at a building. I was removed because I set flowers on the desk of a friend who had accepted flowers from me before.

Initially I was suspended and brought back to work because of the legal contract stating I had to be written up three prior times to be removed but after a week, I was removed permanently because the company in the building of the friend forced the issue by calling the corporate offices of my employer and demanding I be removed when the management of the building was OK with me staying, as it just was a mistake that I didn't follow "protocol".

All in all, I was removed and have lost wages of about 1,200 a month for the last five months with a couple weeks of no work with no pay because I set flowers on a desk? I did not have malicious intent. It was the holidays and I was just giving a gift.

Now I feel like filing a defamation of character lawsuit since they said things like I was a stalker and I created a hostile environment and did all this for personal gain. All these things are false and I am emotionally distressed for lost wages and psychological hurt.

Most important, I have bills to pay and they disregarded contracts which never states that a tenant can remove a guard. They went the extra mile to ruin my career and now I am suffering.

I want to file a defamation of character lawsuit for all the things they called me and their malicious intent to make an example of me, saying this is this the corporate world. No, that is wrong and they are full of it.

That girl knew me as a good fellow always and if anything, she always came to talk to me and now that I wanted to give a nice gesture of appreciation, they throw everything in their power to get rid of me.

I recently appealed the claim for unemployment which was denied by my previous employer. During the appeal, under oath, the executive director lied about the job description title and my job performance.

I dated this guy and on the first date I realized he was a little off-kilter. Two dates later he slashed my tires and keyed my truck, although I did not catch him actually doing it. My roommate saw him in front of the house sitting until about 3 a.m. and as soon as he was gone my tires were slashed and the paint job was all scratched.

Then, posing as his perfect type I connected with him under a pseudonym and he said that he had heard "from my roommate" that I had AIDS. Then today another person contacted me to see if I really was diagnosed with HIV (I don't have it).

I know where this person lives and he continues to spew all sorts of bad things about me. I have not mentioned this person to anyone ever. I thought if I ignored him that he would just go away. I am a very public figure and want to know if anyone has any advice as to what I should do.

I don't really want to go to court but this person has the potential to ruin my good standing in the community.

After being advised to look this up after just leaving the police station 30 minutes ago. from this posting has me interested.

I was in a relationship, and have just moved away. Her ex-husband claimed I destroyed his house and beat her. The police have proven it was a false accusation.

I know for a fact that he did, as well as more than a dozen people have witnessed the results of her being beaten by him.

She has had the bottom half of her jaw broken and lost a baby due to abuse last year. But being a victim, she has refused to make statements and still considers him a friend.

I have pursued the abuse, and without the police witnessing an event or having her make a statement they cannot do anything.

Are there grounds in which I can get this guy for making false police reports? Any help would be appreciated.

I have a situation at work that my supervisor wrote to our Head Supervisor. It states that I hit a fence, damaging the fence and vehicle, and this was a preventable accident. Also that I had hit an awning previously and gotten a red light citation.

In fact a co-worker had thrown open the gate and the gate hit a pile of snow which bounced off and came back and hit the vehicle I was in, damaging the fence and the vehicle, due to the fact I was in motion.

The awning was caught by the rear overhead of the bus while I was pulling away at an angle, approx four feet above visibility of mirrors. The red light situation was due to the fact I was caught between a yellow and red in a commuter bus. I was a respected cub scout leader for two years along with my then boyfriend who had a son in that same pack.

After we broke up, his son's mother told the scout council that there was a DSS order saying that I was not allowed to be around her son. The social worker handling the domestic violence case between the two of us and our then four month old son said that there was no such order. Last year, my step daughter went and lied to cps and told them that i abuse her, which was not true. they were able to find that she did the same exact thing to her grandmother. I was found not guilty two months later by letter. Short story- I was discharged from my company back in May. In May I filed a claim with the labor board for non payment of wages. A few days later, I filed a suit with the EEOC for sexual harassment, wrongful termination, harassment and discrimination. In July, my former employer filed a theft charge in small claims for French roast coffee and hot chocolate. I was the admin and in charge of ordering supplies for the company. He is claiming I 'defrauded and illegally purchased and took home' these supplies. Of course this never happened. I don't drink coffee nor did I purchase anything. I was tasked with signing delivery slips for an order that was put in place many years before I ever started at the company. Is this defamation? He is publicly calling me a thief with no proof other than delivery slips that were signed by at least five people for supplies for the office. I never took a single post it home, let alone $1400 worth of coffee and hot chocolate over a three-year period. He is clearly retaliating because of the claims I filed against him. Will the judge see this? Can I counter sue or is it not worth it? Should I just let his own embarrassment punish him? Anyone?

I was employed with a large corporation and was involved in a wrongful death lawsuit. My company failed to provide adequate counsel due to the facts of the case. I attempted many times to explain to them they are correct about the facts but need to take into consideration where the case would be tried at. Well I was named as a personal defendant in the case and the counsel that was hired to represent me failed to file the motions to have me removed from being a personal defendant. About 30 days prior to trial, they hired an additional counsel to represent me but it was past the time frames allowed to file a motion to have me removed as a personal defendant. We go to trial and lose and I was held responsible for a certain percentage by the jury. Prior to the trial, during the trial and since the trial the plaintiff's attorney has bashed me in person, newspapers, television and in online articles. Now, the company where I am no longer employed has agreed to settle the case but I must agree and sign a letter that I will not seek suit against the plainitiff's attorney. What kind of options do I have? My career has been ruined. Due to this suit, my earned income has been severely inpacted. By the way, I was found not to have committed any wrong doing by all criminal investigators. No policies or procedures were found to be violated.

I am being threatened by a company, who is threatening to sue me for defamation of character.

What for? A few months ago, my lady had ordered a cap for me. Well, they had messed up the order and refused to give me my money back, stating that it was my lady's fault. Well, I was upset by this considering they never even gave us a chance. You would think to keep a customer happy they would gladly redo the work and allow us to send the cap back but no, they didn't.

So, I had contacted the Better Business Bureau, an online site and a few other places about this company.

Well after over a month of not speaking to this company, the person who had given us bad business wrote back, stating they are giving us till September or they are taking us to court for defamation of character. Not their attorney, but themselves.

My question is, can they legally sue us? Considering these sites are legit for people like me who feel robbed. You would think if they could sue us, that millions of companies out there would be doing the same thing and the BBB and such sites wouldn't exist.

I am in the Air National Guard. I was given the opportunity to move on base. I notified my landlord and told him that it would be a possibility. I also asked him if it would be okay for someone to take over the lease, he said he would have to meet this person. I arranged a meeting, he approved of the person moving in. I moved into base housing. A few days later i scheduled a walk-through with the landlord. During the walk-through he didn't find anything wrong with the house. He handed me a letter stating that I owed him for the remainder of the lease and he changed his mind about the other person taking over. I told him that wasn't an option and we had an agreement. I also wanted my deposit back. Later that week he contacted my unit with the ANG and told them that i said i had been "ordered" to move on base. He also lied and told them it was due to the current situation in Korea. It has been several months and he is still contacting my unit. Today i was reprimanded by my unit and I was told that this is keeping me from being promoted and I was sent home without pay.

He is basically telling lies to my unit so they would force me to pay him the money!

A supplier in my trade is spreading information about me that is ruining my life. I don't know what it is. My ex-wife has been adjudged incapacitated for most functions and professional guardians have been appointed by the court. She has been diagnosed with slow progression dementia and suffers from short term memory loss. An uninformed person engaged in conversation with her might assume she was in full control of her faculties, and apparently her guardians believe some of what she tells them. At least they attempt to maintain that she is capable of independent living and provide minimal care. Lately she has been making extremely derogatory statements about me, claiming that I have made numerous attempts on her life and that I have had sexual relations with our daughter and that I even fathered my own granddaughter. Due to her incapacitation, I'm sure she cannot be held responsible for what she says. However, due to the fact that the guardians have not provided a level of care consistent with her actual condition and her being in an environment where others with whom she has contact might believe what she says. I work at a clothing store. One day I bought a skirt at another clothing store and the first day I wore the skirt it tore. I asked the store manager if I could return it without a receipt. She said it would not be a problem. I brought it into the store, which was next to the store where I work. The manager from that store came into the store where I work and spoke with my managers. I hear her telling them about my transactions with her store, implying that I stole from her store. One of my managers kept looking at me funny and when it was time for me to clock out both managers searched my purse as if they were looking for something in particular. Usually in clothing stores, before you are able to leave the store a manager has to walk you out and check your belongings; usually at my store it's just a clean open up your bag and that's it and it only takes one manager. So after I left my store humiliated I went back to the other store determined to exchange my skirt and ask the manager for an explanation as to why she came to my job. When I got there I took the skirt out and told her "if you had a problem with me returning the skirt without a receipt you should've told me this yesterday. You did not have to go to my job and tell my managers" she took my skirt and said "I'm not trying to get you fired I just want my shirt back. When you give me back my shirt you can have your skirt." And she threw my skirt behind the counter. Flabbergasted I asked which shirt she was referring to and she said the one I tried on earlier.

One of her associates said that I took the shirt instead of putting it on the rack and that was what she told my managers.

Now, although they never found the shirt she was referring to, my managers believe that I am a thief and I don't feel comfortable working with these people because of that notion and she didn't give me back my skirt and being that I can not find my receipt she feels that she can do this to me. I know for a fact a lot of my rights have been violated. Do I have a case against this company?

I have a question about defamation of character. I just left a company in which I do outside sales. I was with them approx. 1 year. The owner is upset... occasionally I have customers refer me new customers and we offer them a $100 referral fee, in which he would write a check and I would deliver them. He is now accusing me of cashing some of these checks for myself and is calling all of my customers and telling them that I have stolen checks and questions them if they received their check or checks. My girlfriend's mother is constantly coming to my job and telling everyone I'm a pedophile because she is 16 and I recently turned 21. I know in today's society that might sound strange, but it is legal and that does not change who I am as a person. About 7 years ago I had a coaching position. i was accused by a player of throwing equipment at them. The School board president was there and backed me up with the truth that it did not happen like the player said and they were mad about getting kicked off the team for acting up. I went ahead and resigned after the season. The story of the accusation by the player was in the paper as a small story. It just said I resigned & it did not state whether it was true or not. Years later my ex-wife sent an anonymous letter to the school I coach at now with the article to try and get me fired.(sent anonymously but I can tell it is from her by the wording. She is the only one who would remember this since it happened 7 years before and I had coached at another school since for several years.

She is being vindictive trying to get me fired from what I love. If I can prove it is her (maybe from fingerprinting the letter?)

I have been teaching elementary school for over 30 years in the same school district without a blemish on my record, and most days I love my job. In August, less than a week before school started, my principal received a letter from a parent of a student entering my class this fall that she (and her husband) wanted him transferred out of my class. I received a copy of the parent's letter on Sept. 12 with a cover letter written by my superintendent stating the administration believes the allegations have no merit and there will be no further investigation. I believe the parent was summoned to the superintendent's office the day before and interviewed. I used the word "summoned" because the parent is the secretary of another elementary school in my district (only 6 schools). I believe this is her second year and I have never met her, had contact with her and didn't know who she was until I looked up her picture on her school's website.

As anyone would probably predict I now suffer from physical and emotional symptoms caused by stress from this event: I can't eat, sleep, concentrate or think clearly. I have tightness in my chest, I feel dizzy, cry on the way to school and feel like vomiting much of the time. I had to seek medical attention. In my opinion this parent/secretary insinuated that I am some kind of a child molester and she has irreparably damaged my good reputation by her libel. I would like to sue her for monetary damages and force her to name her sources, if there truly are any. I can't claim that I have suffered from her libel at work as yet, but it's only a matter of time before her malicious gossip circulates this small town and my principal will be getting calls to have other children removed from my class or not placed there at all. Do I have a good chance to win a defamation of character lawsuit against this parent/secretary? If not, do you have any other suggestions to force her to stop her slander?

Since I only received the letters (supt. and parent) on Friday, the first opportunity I'll have to contact an attorney is Monday morning and I plan on doing so. Should I contact the attorney I usually use for real estate or contact one specializing in defamation suits? Thanks for helping. This has changed my life and my soul. I doubt I'll ever be the same. I started my job as a full time youth pastor 9 months ago. I came into a hostile environment where the old youth pastor had been grooming the interim youth pastor for the job. I got it instead of him. I moved here from out of the county. However, the guy still goes to the church. Since I have come here they have been going about everything they could to defile my character to get me fired. One of the rumors they have started turns out to be linked to my case with job and family services.

They are spreading the rumor that I owe the government food stamps and that i refuse to pay them. They went on to say that My husband refuses to work them off and that they offered for us to be able to but we refused. This is not only not true but it is also information that only job and family services would know. A woman who works as a supervisor at Job and Family services goes to our church and is part of their posse. No one else has the ability access such information. Now my job is saying because they have done such damage to my reputation, that my ability to do my job has been severely damaged and they are considering firing me. What can I do?

This can even effect my ability to get jobs in ministry later because what happens if someone who heard and believes this rumor is in power at this church when I need a job reference in the future?!

Allow me to give some background on our neighbors. They have harassed everyone who has lived next door to them. They met at an Alcoholics Anonymous meeting. They have no kids. They live for their plants. (They get every 4 hours to water and groom their lawn.) The Husband is black and the wife is white. [You'll understand this part later.]

My mother, brother and I moved into a duplex about a year or so ago. Everything was OK to start off, but about 5-6 months after we moved in problems started to arise with our neighbors of the duplex. My neighbor and his wife are from what I've seen insane. The husband trespassed into our backyard and cut down this huge beautiful bush. When my boyfriend confronted him about it he said that he had knocked on the door and he also had permission from the owner to cut down the bush. Well, I was at home all day and there was no way that he could have knocked and I wouldn't have noticed, and secondly, come to find out, the owner never gave him any permission to do anything. That was the start of all the drama. We have gotten into screaming fights with them where the wife called my boyfriend, his cousin, and his cousins girlfriend the N word, when the husband is black himself. Also, they threatened to "ruin our lives,"well they sure are trying hard. From then on they have been calling the police once a week if not more saying that me and my family are selling drugs, and having outrageous parties with drugs and alcohol which is completely untrue. They would call the police at 5:00 am saying that we were blaring loud music, when everyone in the house was asleep. They started pulling their car out of the garage at 3:00 am and blocking our garage so that my mom couldn't get out to go to work. Then there was one occasion where my boyfriend parked his car slightly sideways and they called the police saying we were blocking them in, when there was still plenty of room to get out of the driveway. The same day as the car "being parked in their way", I was getting home from work when I got a knock at my door, and this time it was CPS. A CPS investigator came to my house saying that there was a call saying that I was abusing and neglecting my 9 month old son and leaving him inside the house for hours at a time. I am one of the most protective mothers I know, in no way have I ever brought any harm to my son. So the CPS officer had to search my house, check for running water, heat and electricity, along with checking my sons body for bruises or signs of trauma. That was so incredibly humiliating. After that, the owner of the complex warned them that she would evict them if they kept calling the police, because if they continued she would be fined by the county. Now, they have stopped calling the police and started calling the pound. They called the pound and an officer showed up at my house with one of those sticks they put around dogs necks to take them away. While talking to the officer, he told me that there was a complaint to our specific address saying that our dog had been running loose around the neighborhood and chasing children. Which again was untrue. That was the last thing that they have done so far but that was a couple days ago so I'm going to be waiting for something else soon. I have spoken to a couple law firms and also called the police station for advice and they all say there is nothing I can do. I need some advice. Please help!

I have a neighbor whose mother assumes because her 16 year old has a crush on me and we have a friendship that I'm a pedophile. I'm a 36 year old wife and mom to 3 children. One of my customers recently sent a letter to my superior, making false allegations against me. The customer attacked my character, alleging I have made inflammatory statements that constitute "false lights" (not sure what that means). I have demanded a full retraction and apology, which I doubt I will get. Do I have any legal recourse? I have a friend of 4 years who i have been close with, we have communicated some delicate situations i had told in in full secrecy with him not to divulge the information, I have to say he is young and he does not know much in education. after 4 years we had a fight due to a gossip that he had received from someone who said that i was the one who told that he was just a servant. I have a question regarding something that occurred in my workplace just this past week. I had a bit of an argument with a coworker and later her friend (another coworker) accused me a slander toward her friend. She told the other coworker's supervisor that I said something that I didn't and it was then taken to the branch manager. My supervisor was oblivious to this until later that day. I thought that it was all just water under the bridge by then, but was later called into my supervisor's office asking what had happened and if I had said what she said I had said. Is she liable for defamation of character and would I have the right to sue her or the company?

My daughter and her ex-boyfriend have a son together. They broke up. They are going through a custody battle. She has always been the primary caregiver for her son. She is the only one who has taken son to doctor appts, well check up visits, bathes him, feeds him, there when he is sick, stays up with him at night when he is sick, etc. Her ex-boy went to her insurance company and told a couple of the girls there that my daughter stole his credit card and made purchases of over $8,000. And she always has her son with her--she does not party, and her son is her pride and joy. Always looking out for his best interest. EX, is telling all sorts of lies about her to try and get custody. He cannot prove anything he lies about, but, it still puts the thought in peoples minds when he lies about her, especially when he lies to people she does not even know. He tells people that she abuses her son. He is telling people that she takes drugs. She tried to get into a low-income apartment and he told the apartment manager that she parties all the time. She didn't get the apartment. Is this defamation of character when he is causing her so much anguish and humiliation and keeping her from getting an apartment??

My brother wrote a letter to my parents housekeeper and then she read it and it said in spanish "You're a fat ugly b-," then she started gagging herself and threw up. Several years ago my supervisor was making fun of a pair of white boots I was wearing and said jokingly that I looked like a go-go dancer in front of a colleague. Well, this colleague has spread the rumor that I am a go-go dancer. Horrible. I told my supervisor that she had better tell him that I am not or never was a go-go dancer. She told me not to worry, that he was harmless and a loser. His son committed suicide and his wife left him on the same week. She has since retired and he still believes and spreads the rumor. At the beginning, I cared less because I know who I am and where I have been. Recently, this rumor came back to me by a friend after I volunteered to help a teacher with a dance club at school for hispanic students wanting to dance salsa. I am shocked that it still spreads. I want to make an issue of it now. But that is not the story of why I am so furious and hurt. I spoke with my brother-in-law and asked if he had heard the rumor and the reply was, yes. My husband also heard it months before he died of cancer and had said nothing. We were separated, but yet I and our kids were with him till the end. He died not mentioning it to me or asking me if it was true or not. I am hurt. My brother-in-law said it was not a topic of discussion when he was with him. My husband took my name out as beneficiary of this life insurance and put my brother-in-law instead. He holds it for my children's college fund. I trust him. Truly, I would have done something then, if I had known.

Is it too late for me to take any course of action? Should I take it to my Union Representative and have an intervention with this guy? He has cost me a lot of anger and pain. Enough is enough........

OK so I have an ex co worker who quit his job...no one at work really likes him..if anyone talks about it is really all truth..the guy is a sleazy if I must say. On the day of quitting his job he states that if anyone up at his recent place of employment talks about him in any of their conversation..then he could sue for defamation of character. Of course his character is really in question too. Technically if he had any plans on suing shouldn't he have not quit his job. I am writing everything down, but it is time consuming. You are right about the new job. This co-worker is also stealing my accounts. She is not supposed to touch any of them, she should find her own, being relatively new at the company, however since she can not sell on her own, she is stealing existing customers where she knows they are frequent buyers, she also lies to them, that she has a higher position than me. After reading all of these posts, I am shocked at the number of nasty, malicious people out there !!

I am in a situation similar to many on this board.

This involved the defamation of my 8 year old son's character. We have a 51 year old neighbor who moved into our neighborhood about 3 years ago. The home is actually owned by this woman's elderly mother & the older woman's boyfriend. ( however, my neighbor claims it is hers and that her Mom had to help them out because her granddaughter had cancer and she had to quit her job to care for the child...needless to say, the child has been in remission for over 2 years)

Anyway, we were friends with this woman. I tried to keep some distance because she is very clingy and didn't understand that when I get home from work, I didn't want her hanging around my house complaining about our neighborhood that she refers to as "the ghetto". ( my home is valued at over $300,000 and is actually quite nice...as are most in the neighborhood ) Her 9 year old granddaughter lives with her and played with my son. This little girl didn't want my son playing with his best friend who lives across the street so she would make up lies and tell her grandmother who would then go ballistic. I have watched this woman scream at neighborhood kids on numerous occasions. Last Summer the little girl was in my house and the boy across the street showed up. She told me, "my grandmother won't let me play with Seth". I told her that if that were the case then she would have to go home because in my home, everyone plays nicely together.

Several weeks ago the girl and her 7 year old sister were at my home playing with my son and another child. She claims that my son's friend punched her sister in the face ( there were no bruises or signs of trauma ). I took my son aside and asked him what happened and then took his friend aside and asked him. I got the same story from each.

The next morning my son went down to this girl's house to see if she could play. The grandmother came outside and started screaming at my child for "siding" with his friend. My son is very shy and not used to yelling. He came home visibly upset and shaken. Oddly, the grandmother didn't come down to my house like she usually does. A few days later, my son was still afraid to even ride his bike by her home. The girl sent one of her friends down to our house to summon my son to come up to their house. I told the child no, that my son was very upset because the grandmother had screamed at him. I told her that the woman needed to come down and apologize.

After several days, my husband went down and asked the woman what happened and explained that our child was very upset. She said he was being too noisy at their house so she yelled at him ( she then launched into a tirade about his friend who allegedly punched her granddaughter over a week ago ). This woman is acting really strange and I am now noticing her running to my next door neighbor and the woman across the street ( people who she couldn't stand a few weeks ago ). On Christmas day the granddaughter came down to our house while we were outside, her Aunt came down and told her that her dad ( her parents are not married and her dad only stops by on Christmas or birthday) was coming over. The girl starts yelling "HE HITS ME ! I DON'T WANT TO SEE HIM". This startled us because she doesn't have any contact with her father. He doesn't keep her on weekends, holidays or even pick her up and take her places. For all intents and purposes, he was a sperm donor and nothing more.

The little granddaughter is being kind of cruel,when my son is playing with his friend, she will come down and tell the other child to come to her house and she will give them pokemon cards or something else. This has left my son in tears.

Yesterday, my husband and I were relaxing in our front yard. The granddaughter had been riding her bike near my house ( waiting for my son and his friend to come outside or something ). The grandmother comes outside and yells "Lori come back down here, those people are SICK ". My 80 year old neighbor came outside and I commented that this was getting out of hand and ridiculous. She said she was tired of it as well and said that the grandmother had come over yesterday with HER side of the story. She is telling my neighbors that my son said to her granddaughter, "show me your tah tah". This is NOT the reason she told my husband she yelled at him. I am mortified ! I am terrified she has repeated this to other neighbors.

My best friend is an attorney and has told me to confront her and tell her in simple terms that the "slanderous" and malicious gossip is to cease immediately or that we will be "forced to take legal action". I am terrified to even approach this woman for fear of what other lies she will make up. In this day and age, a child can accuse someone of molestation and the accused party is guilty until proven innocent. My husband and I are working professionals....stereo typical Yuppies.

I was speaking to a co worker on the phone and during the conversation made the following comment "I am headed to Palmetto to find me a psychiatrist before I go postal and kill everyone." It was said in an obviously sarcastic tone. It was said off work premises and after work hours. The person I was speaking to took it out of context and embellished, rather changed significantly, what I said and most importantly what it then meant. She told the administrator that I had said "If I don't find a psychiatrist I am going to go postal and kill all the employees in *****(my) company" No one ever called me and asked what I said. I have been laid off of work without pay. The police were called then canceled. Every co worker in two locations was told the incorrect information re what I said. At this point my entire company thinks I am some kind of killer that is laid off for mental health reasons. I am humiliated. In this line of work people come and go and you always see them again. I feel that my reputation and future in this field is in jeopardy. What I said should not have caused this reaction. It seems too easy for someone to slander me so easily and end up resulting in this. Do I have any recourse? Happy Holidays.

wow, that sounds like a tough situation you're in. i would immediately consult a lawyer (if you have one) or see if there is a local agency such as legal aid, that can give you some good legal advice to protect you personally and your job. in regards to your job, i would seriously consider finding a new job. it sounds like your working conditions will be strained and uncomfortable to say the least -- especially if this coworker stays on. document EVERYTHING that has happened and happens in the future so that you have dates and information you can use to protect yourself. also, i wouldn't give my co-workers ANYTHING they could ever potentially use against me, so remember to keep it professional at all times.

I am not sure either, whether or not I can do something to stop my new colleague attacking me with a defamation.

A testimonial was written by my colleague (and I have a copy) that I have been speaking badly about my manager, general manager and some other employees, including some of them having sexual relationships together (higher management and workers). It is an impressive list of lies, that are actually even hard to believe.

My colleague really must have worked extremely hard to construe something like this.

I was asked to go on administrative leave for 2 business days so that an investigation can be done. What can I do in this case? Thank you very much for any help.

Last week I learned that I am getting sued for “Maliciously and intentionally failing to disclaim that a property I sold could be subject to basement water damage”. HISTORY: My wife and I bought land and divided into a small subdivision. In 1997, we built a home on the property. A year later I was hired at a new job which required that I live within a certain distance from the office. I also sold the remaining lots in the subdivision. Now almost 6 years later due to a heavy spring melt and rain, two of the homes experienced water damage in their basements. They contacted me to meet with the Township Board to discuss ways to divert water coming from another property (crossing a State highway) and keep the water away from the house and land I developed. The township and county told the new owners they will not do anything about the problem. So now the two owners are claiming that I failed to tell them that water could do damage. This is very hard to prove for one and they also filed 4 days prior to the statute of limitations.

Here’s my issue… Once friends of mine, they are taking me to court. I have the all parties involved in my development supporting me as the water coming in the land I once owned is not a result of anything that we did while developing the land. I am a Police officer and have been for 11 years. In my field of work, character is EVERYTHING and allegations of being untruthful can get me fired from my job or worse yet cause problems in the event I go to court and have to testify that my investigation is true and correct.

The two that are the plaintiff’s in this case are also cops. My question is can I sue for Defamation of Character? I feel that God help me I am taken to court by someone I arrested or worse killed as a result of an act they committed and now I am in a wrongful death civil suit, I am worried that due to public record anyone will see that I was once sued by TWO FELLOW cops and that they said I lied to them. Now there could be a doubt left in the jury that I lie. I have NEVER been disciplined for being untruthful and am worried that this suit could have long turn effects on my career. CAN I COUNTER SUE? Any help would be great.

My husband and I recently severed a business relationship and it did not end on the best of terms. We found out from another of our clients, who had just come from a meeting with a banker who we have done business with previously, that the bank wouldn't consider him for a bank loan if we were his partners on the deal. The banker said he couldn't elaborate, but it was because of our previous business partner's statements about us. This will have a huge impact on our business. I had an employee(secretary) that i caught inflating her hours, and asked her to correct her hours on the next check, well she still proceeded to print a check out for the inflated hours and when i confronted her about the check, she said she forgot, and i asked her to shred it and print another one out, so a couple of days later, i had this feeling she did not do it, so i asked her,and she informed me that she did, well the bank said that they had to checks cashed and they also faxed over the copies of the deposits, long story short, she walked out on me, simply cause she did not want to admit she was in the wrong and to put it simply, stealing. She is going around to people, telling people she is going to take my business down, she admitted to people she went in the computer and took numbers out, she refused to give the key back for the office, and is making up stories about me that are not true, so it coincides with her intent to take my business down.

I really wish you the best. Thick or not with the VP, the VP needs to know the truth. Everyone else knows it, and if this dude is attempting to ruin your reputation, occupation, or marriage, he needs to know there are legal steps you can and will take, and your company is also culpable too, if they take action based on false information and accusations, particularly with the malicious intent this dude has in mind. He is one malignant character indeed. He does not deserve to have a place with this company, I don't care HOW thick he is in with the VP, and maybe the President needs to know about this, and if you lose your job or other important things to you, the company could end up paying as well, as they are very much indeed in part responsible for the actions of this man.

Thank you Kennlock, I will have a chat with him about this first thing monday morning. Till now he does not know that these people have told me about the papers he wanted them to write. One thing is, that he is best friends with the vice president of the midwest region and he have said in the past "as long the VP has a job in this company, he is guaranteed a job" which is true that he backs him up 100%. From what you said have said already, you are very strict in your religion and happily married. Why would your wife believe all this rot and lose your marriage and how could you lose your job with 12 witnesses? What are you worried about? Put a letter together, signed by the witnesses and send it to your REAL superiors. Your situation sounds cut and dried to me. It amazes me, if everything you are telling us is true, how folks in a situation like this can worry about all the things you are worried about. Sounds to me like this buzzard needs to lose his J. O. B. !!! You answered your own question when you said "if this 'defamation of character' spreads far enough".... that's the point! Most should see it for what it is: gossip, lies, and false defamation of character. Nip it in the bud by going right back to the bosses with, as Paul Harvey puts it: "The Rest of The Story". Get it? And cut and paste your letter here, and this answer as proof to show your concern; that you even went to the internet to get some advice. I hope this helps. Please answer back if it does. i work with a company as a front end manager and my branch manager dislikes me and even suspended me for a week for something simple. I got in contact with most of our corporate members, they receive numerous feedback about my "superior customer service" so they paid me for my week off and i was brought back to work and he was informed that he does not have any power over me. Anyhow, so far 3 of my employees and 2 assistant managers came to me this week and told me while i was on suspension he persuaded my employees to write sexual harassment letters against me. For return he promised them a higher position. So now he is trying to say that i sleep with my employees. I am happily married and I am very strict in my religion. I have a total of 12 people that witness he dislikes me and he wants me out, while the rest of the company are against him. If this defamation of character spreads out far enough i can loose my marriage and loose my character in my community and also loose my job. Plz tell me what can i do????

I would like to know if I have a case for Defamation of Character or something else.

I'm an Independent Contractor and the President of a Nevada Corporation and work for a Federal Contractor overseas. The Federal Contractor sent out an email to all ICs about our new contract. While on duty overseas, another IC called the Federal Contractor and left a message stating that they were me and said my name six times. The caller threaten, complained, and bitched at them about the new contract. I have the message recorded on file. The Federal Contractor then contacted me wanted to know what the hell is my problem leaving a message like that. I was in a world of a mess and could have been fired. However, they know I didn't leave that message because the person's voice on the message is not mine. They are investigating to find out who did this and they will terminate him ASAP.

I work in a war zone and it's stressful enough!! I don't need this added stress. I'm not sleeping, eating, I'm not thinking clearly and that is a dangerous combination. It's dangerous enough here, not to mention with all of this added weight to think and worry about. This message incident has me nervous and pissed. I'm nervous because I don't want any problems or my name to be tarnished. And I'm pissed because I can't believe someone could do this to me and I don't want this person to do any more damage than he has already done.

What do you think; do I have a case against this person and is this criminal. Please let me know.

"You can't unring the bell"...I recently posted a scenario on this site that I believe to to be the venue for constant "defamation" issues, which do not seem to rise to a "real" defamation of character because they relate to Custody Disputes. For some reason, it has not been posted. Well anyway, when an individual and/or his attorney start making up lies to hurt the other party and gain advantage regarding, "What is in the best interest of the child", I should hope that someone should take notice. Of course, it will often be said that the the allegations made are "irrelevant"..but the strategy of providing false information is all too common in the COURTS! Why? because no one sees the consequences that can potentially harm the other party, except for the clever individuals who are committing the "defamation".

It's me again!....the wife with the husband being used as political fodder....we're getting closer to election time. Things have gotten so bad at work for my husband that he resigned and found other employment. Since, we've contacted an "employment" attorney to look into the situation. It seems to me like he is hedging on taking any action at all and I don't understand. The candidate keeps hammering at my husband's reputation and work ethic in the newspaper even after my husband has moved on. Not only has he (the candidate) posted a police report that we believe was fabricated on his political website, he now has posted a copy of my husbands resignation. Now, not only do I think there is defamation/libel case here, personnel records that are confidential have been compromised that is a violation of the "sunshine act", I think. I would guess that an inside staffer of the township saw the resignation, copied it and gave it to the candidate. So I'm looking for some advice here....any help out there? The attorney we are working with said he'd spend about an hour or so to determine whether its lawsuit worthy or not....Kennlock...your opinion would be a great help!....And if there are any attorneys out there who wants to take a look at the website itself, e-mail the monitor and ask for my e-mail address. You guys have to remember, my husband just turned 60, been doing this municipal work for about 25 years. He is looking at retirement in the near future and if these actions cause him to loose his new job....where/who will employ him then?....We still have bills to pay and he'll still have to work somewhere.....

I tried to post some good advice to angelo. I will once more. It is futile in my humble opinion to file lawsuits against people like these. Take your husband and at least one other person and confront the party and nip it in the bud. Take a tape recorder in your hand and let the party be aware you are taping the conversation. Period. Make it really plain and simple you will not put up with this. In fact, let your husband do the talking. I am sure if he is half a man he is quite capable. Oh, and admin, thanks for keeping this post up. This is my last post.

I am in need of some advice regarding defamation of character. My husband and I are in a seasonal campground and we go there on weekends and sometimes a week at a time to relax and get away from our hectic schedules. Recently, we have had a problem with a man (approx. 70 years old), if things aren't run or done in the manner in which he wants it he creates problems with people. Him, his wife, daughter and son-in-law now have a problem with the manager of the campground and have said some pretty nasty things about her. My husband and I were friends with both parties until recently. I took on the responsibility of refurbishing a rental trailer to get it up to date and ready to rent as a favor to the manager. In the meantime I did not realize that rumors were be spread through out the campground about me. A complaint went to the manager's office from a new camper in regards to the fact that this man said some really, really nasty things about me and what I was using the rental for. The complainant said he did not want to hear this kind of talk and did not want to get involved. The complainant also said that since he had not met me yet he felt very uncomfortable with what he was told. He also is an elderly man. I cannot write what he referred to me as. He claimed that I was getting this camper ready for my own use so that I could have my husband in our camper and use the rental for all the other men. I am so upset and I don't think he should get away with this. I feel that there should be consequences to your actions. Everyone let's it go because he is old, well he still has his faculties about him and he knows what he's saying and doing at all times. I realize that he's an evil person and I should just ignore him but this is about my reputation and what I stand for. He has called me and other women things in front of people. Any advice out there on if I should pursue this or what can be done? I would appreciate any advice.

I need some advice on I think a slander case. I recently quit my job at a assistant living home because of work and school schedule issues. Now I heard that a co-worker is saying that I got fired because I abused the residents. I way I heard this was because a friend of my father heard it from another person that knows my ex co-worker. I am afraid that this co-worker has told many people. What can I do?? I am very upset because I am afraid that it will hurt any future jobs I may apply for if word gets around. My GM at the restaurant I am working as has accused a manager as being a drug dealer. He is not, yet she keeps implying that he is and is using those who she knowingly use drugs to spread these rumors and lies about them.. Does this have any legal merit for Defamation? Will getting the conversation on tape hold up in a court of law? Any help will be very helpful!!

Yesterday at work I was accused of keying a car that was parked at the dealership where I work. The 34 year old owner said in front of my coworkers you did it. I am 56 years old, and i am extremely hurt by this accusation. Do i have any recourse?

Obviously you have a good relationship with the owner of the dealership, and he is on your side, or you wouldn't have heard about the letter, -- about accepting the coupons? He might just want you to continue to accept them if this guy is a "cash cow" for his dealership in a recessed market. Copying expired coupons is not a "new art", and this guy is obviously a con!, taking advantage of your companies good will. I'd recommend you keep that good will if you have some in date coupons. Give him a few, and when you do, gently remind him that copying an coupon is no different than counterfeiting. It's FRAUD! So, when you sweeten it with more coupons, it's called turning the other cheek. Discuss this with the owner. As far as tarnishing your reputation, the only reputation this cheapskate has tarnished is his own. Yes, I'd say he tried to defame you all right, but in "stepping" on you he lowered himself. He is not worth the time of day. Hey, and it IS your service department! Have you not read in Genesis we are to go forth and subdue the earth?, and rule over it? The service department IS your kingdom! Rule it with Justice and Humility, Mercy, and Pride, the right kind of pride of course. Uplift those around you; encourage your employees, and speak kindly of your adversary. He really doesn't realize what he is doing. The one he is really defaming ultimately is his self. I am a service manager of a large new car dealership. To date we have serviced over 8,000 vehicles and we are one of the highest rated dealers in customer satisfaction. There is one customer who has bought several vehicles from our dealership and also services the vehicles at the dealership. The problem is when he brings any of his cars in for service he brings in a coupon that he copied off the internet that was used in October 2002. It's a copy of the original coupon but without an expiration date. I allowed him to use the coupons on his and his family members' cars because he had bought several cars from the dealership. I then told him that due to the fact that business has slowed down I would no longer be able to honor his coupons that expired 10/02/02. I also instructed my employees not to accept those coupons. he then wrote a letter to the owner of the dealership complaining about me not accepting his coupons and in the letter he called me a "Gestapo-In-Charge" and called the service dept "antrey2 kingdom" I feel he wrote this letter hoping it would get me fired and that would result in tarnishing my reputation. Is this an example of defamation of character?

I was let go from a job a few weeks ago where I held the position of lawn maintenance manager. I was asked to commit acts of fraud on behalf of the company because he didn't care for the property manager at this one particular apt. complex. The owner asked me to call the nursery where we get flowers and see if they will come up with some "phony receipts" in case the property mgr. wanted to see proof that we put in "X" number of flowers. I advised him that I didn't think that was a good idea and he responded, "please just do what I ask!" I didn't like doing it, but I did. We got the phony receipts he wanted. I didn't think this was very ethical and it went against my better judgment. He told me I sounded like his wife, etc.

He also doesn't hold a pesticide license, but advertises on his website that he has NJ. State license when it comes to lawn care, fertilizers, etc.

He also hires illegals and has them drive company trucks when need be.

I have posted a blog on myspace concerning his unethical ways and also contacted a few people I dealt with at a few properties letting them know exactly who and what they are dealing with.

IS THIS DEFAMATION OF CHARACTER???? OR does he have to have some character to defame in the 1st place??

My girlfriend is worried about me getting sued for defamation of character and thought I would search the web to find out more about this.

I am also going to talk to an attorney about my firing. We in NJ. are an "at will" employment state but I also feel that because of my threats to expose him for these things, I was let go. In one conversation I said to him, "let's ask DEP and see what they think?"

There are serious fines for doing business in NJ as a pesticide business but not being licensed, but I don't know how well they enforce the law!

You can lead a horse to water but can you make him drink???

I'm certainly no expert, but I absolutely agree with you, Anonymous. In order for your ex to have a case, he'd have to prove that he's suffering because of what you wrote. If his name isn't in the book, then that will be very difficult for him to prove. I wouldn't lose any sleep over it if I were you.

I wrote a poetry book and my ex-husband got a copy, in my book I do not mention his name, only his actions, like him cheating on me. He claims that he is going to show it to an attorney. All lines in the poem are true and since what happened between us also happened to me, I think that I have a right to write about my life, as long as I do not mention his name. What is your opinion? I think that he has no case, because he will not suffer any loss from the one poem in my book.

In fact, you have posted a much more worthy defamation post than my own. I will go on to say slander and more. I wish I knew more detail. Unfortunately there is no way, unless you email the moderator, of putting us in touch with one another. I am not an attorney, but I am hopping mad already from what I read, and I am ready to take up the banner for your cause!!! My husband has been made political fodder on a candidate's website. The candidate is running for a municipal supervisory seat and using the theme of "good government" has posted things on his website and spoke to reporters about my husband and his work ethics. He is an "at will" employee with the municipality which means that he can be dismissed without cause. Which is the candidates intension if elected. My husband has done nothing wrong. The position he holds is non-political. We feel that this information posted on the website will effect my husbands work ethics and reputation when it comes time for him to look for another job. Can anyone provide any advice on if we should pursue the candidate in a defamation lawsuit or is there something else we should be doing beside sitting idle and watching his career go down the drain?

Thank YOU for not coming down too hard on me. I wasn't quite sure how you would take my apology, and though you did give me some well deserved rebuke, you showed some kindness. I am the same kind of person you are talking about. I am for the "underdog".... have been all my life. I am sick and tired of seeing folk being downtrodden, and I am sorry for your situation. I really wish I could offer some counsel; some solution, to help you in your situation, i.e, the injury that you feel you might suffer in your job, etc. In my case I think you may have read up the thread, I DID purchase the online book on defamation... It helped me NOT to file a suit against the ex neighbor that was accusing me of stalking her (I think she suffers from parnoia)... But there might be some good advise in there for you how to put a cease and desist letter (sent certified), along with a demand for retraction to this slime bucket, what he is doing to you. Slander is slander, if it degrades a person, even if it is personally and intimately correct, because the intention is to hurt, which is obviously slime bucket's intention. That STILL qualifies as defamation of character. You would need to read the book to understand. If you cannot get the book, you might want to check your local library to see what resources on def of ch. or available there. I wish you the best! And thanks again. I offer my sincere apology once more along with my sincere regret for your bad experience with this slime bucket and hope you can resolve the issue and stop his running mouth.

Well thank you for at least admitting it and apologizing. It was a slap in the face after being hurt once by one man and his co-workers then try to find some help and get made fun of for it as if all women are playthings. A man wouldn't think it was too funny or say those type of things publicly if I happened to be his sister. Thank you for your information and I hope you don't judge others as quick next time. I do understand your frustration, I just think the world would be a much better place if people wouldn't judge so quickly. Unfortunately I do not have money for such a case but who knows maybe I will find some good hearted person that would "pick up the cross" but I really doubt it. I say thank you because that is the type of person I am even though I really am still quite hurt by what has been said by everyone...it sure didn't help me start believing in any men again anytime soon. There are so many folk who come on here looking for a quick fix that I get frustrated at times that they come in here, hit and miss. I really do apologize that I have hurt you. So are you implying that I am not a decent woman just because I dated a guy that ended up being a jerk? "Which means you might want to make some changes." I think I already thought of that genius. I think that is exactly what you were trying to do because no where in my trying to get some information did I give you any reason to assume that I was an indecent woman, only one that made a mistake by trusting a man that was a very slick talker. There are decent men available, of course those men are looking for decent women. Which means you might want to make some changes. I don't mean to come down hard on you, because in cases like this, the women get a raw deal, just like as they do when they get pregnant.

Back to the defamation of character. The guy probably doesn't have any money. No lawyer is going to touch it. To put it bluntly, you may have gotten ---ahem--- "screwed" this time. You have a tough issue to deal with. Almost everyone I've seen here has a no-brainer case so far..... no case.

I'm hoping to get some help and information here. A friend of mine told me to look up this topic because of what I'm going through. My situation is that I had dated a guy for a while and I thought it ended just because he wasn't ready for anything serious. Then I come to find out from his neighbor (whom I had become friends with - I'll call him "Bob") that he actually was dating several women. That was even more heart breaking but not the big problem here though. The problem is that "Bob" told me my ex boyfriend was telling everyone at his place of work all about our intimate relationship in detail! My ex boyfriend told all of this to "Bob" I'm assuming because he had thought about dating me. I was sickened and horrified!! We are talking about very intimate details being talked about at a place of work and in public that makes me feel...well I think you can imagine how it makes me feel. No one should have to put up with such things! So my question is, is there anything I can do about it? Is this truly considered defamation of character? If this got around to my place of work (which it very likely could) it could hurt my job, especially me being a woman being talked about in such a way. This guy doesn't seem to care who he hurts and I know if he's doing this to me he more than likely is doing this to other women too.

hello well where to start first my bother is in jail and 2 women have been on his yahoo account and messaged me on his account then i told then to get off his account and they said they were going to post this thing on don't date him girl a web site i guess well there are a lot of slanderous statement on this website about me not to mention my lil brother has had a posting made against him as well. what i want to know is they have now made a impostor profile on myspace.com about me and my my lil brother and also have i will be posting the myspace id's on here also so you can check them out i mean we have notified myspace about these Impostor profiles and have reported them and myspace has not done anything about them also while i was in florida i had attempted to apply at this one job and then come to find out one of these persons in question had access to personal information such as background check, job history, and also financial information as well as the application itself even though she was not in a managerial position or even a supervisor of any sort is there anything i can do i have them on messenger openly admitting this statement and doing these heinous defamation of character on myspace here are the 2 myspace pages that involve me and my brother

I purchased the ebook on defamation of character. I think it would be really helpful, and no, I am not being reimbursed for "putting a plug in" for the forum, or whatever. It was really very helpful in my NOT making some serious mistakes. As a result, I decided NOT to file a defamation of character suit, though I rightly could have. Remember, I am not a lawyer, have no legal expertise; I am just trying to offer what I think might be some common sense ideas. Ugh! Yours sounds like a very Ugh!ly situation indeed! -- to say the least, and very complex; because it is not merely just defamation of character, but tied in with legal proceedings, and a little more difficult (did I say a little more difficult?) to sort out. If the legal proceedings were not going on, it would be more slam dunk, ....but, they can say they have good reasons for "making the accusations", and it is not uncommon for this to happen in divorce proceedings; to make matters even worse! Well thought out or not, it is an intentional tactic, to tear you guys up. It happens every day. The only remedies from a defamation of character lawsuit are financial, and if there are no sizable assets to be had, I don't believe an attorney is going to touch it. It is pretty much of a civil matter as far as I can tell. But don't take my word for it. I would ask your attorney, bottom line. So far as I know, no one peeking in here has the legal expertise to answer you. I wish I could offer you more than that. If you got the extra $20 though, I'd consider the book. It was a definite help to me. I wish you the best, and I hope this helps just a little, at least to get a clearer picture of what you are up against. The allegations were made against my father. They were made by his ex wife, who was attempting to alienate his children from him. The allegations were found to be false after several months. My dad was never convicted, and no charges were ever brought against him. Now, over 20years later, out of spite...my dads ex wife got in contact with my child's father. Told him that my father, sister, cousins, doctors and several other people have sexually abused me. She also told him that my sister sexually abused a baby. These allegations are totally and completely false. So, my child's father has brought this up in our current custody case. An investigation was done on my father, which turned up nothing. Even though the court has told him that the investigation was done, and my father is cleared, my child's dad keeps bringing it up every time he files something new. Along with making other kinds of wacky allegations. I know my dad wants to sue her for defamation, and sue my child's father...But, what can I do? It's all being brought up in MY court case, which is really frustrating.

Is the person being slandered the subject of the court case? If so, have there been new charges filed in an unrelated case? Who is making the accusations against this person? There is a lot of information that you are leaving out. If the person being slandered is not the defendant, how does it bear on the case. It would help if you registered, so that we could help better. We still won't know who you are. No one get's your email address. No one has mine. But if you don't want to, we'll still try to help, but we need more specific information.

over 20 years ago someone close to me was falsely accused of molestation. After several months going in and out of court, the charges were dropped, and no there are no convictions on their record. Recently, over 20 years later, the person who made those allegations told another person, and now those allegations have made their way into a current court case that I am the responding party in. Is this defamation because the allegations are false, the person was never convicted, and this person is making all kinds of other allegations now that are ending up in court papers. Im at a loss here...i don't know what to do.

First, you didn't say the "someone" is identifiable. Without that, you don't have a case of defamation of character at all. Even then, if you do, you must know what the basis of the accusation is on. Of course, if the accusation is false and baseless, sounds to me like you have a case of police harassment. For what is the court date? What are the trumped up charges?

My son-recently enrolled as a college freshman-has a problem. It seems someone said that he was looking to buy drugs-a statement that is untrue. Unfortunately, the police were notified and he was questioned, his room searched and a court date set. As the statements about him were untrue, does this constitute defamation?

I have a situation that I would like some comments on. I am pursuing a case of Wrongful Discharge in the state of Pennsylvania. There are many different avenues to this situation and I will try to keep it short. I was hired as a Property Manager for a 407 mobile home community among the interviewees were myself, the previous property manager's friend and another woman. The previous property manager received a promotion with the main company to regional manager. When the phone call was made to the friend of the regional manager who did not get the job the comment was made that "When she is fired you are next in line for the job" the friend persisted on complaining to her friend about the decision. Made a comment that "now she is going to let all of the n*****s and sp***s up in the park" I have a mixed child and my husband is black. These comments were relayed to me first hand from her friend after having a falling out. I was sad that race was brought into anything. See the Previous property manager didn't make the hiring decision only to take part in the interview. Since day one lies and defamation of character took place. Tenants coming up to the office made me aware of this comments. The maintenance man for the community was also spreading confidential information around that he should not have been. Being rude to tenants giving the middle finger to a gentlemen after the gentlemen who was getting his mail. Lying about my personal life and not doing the work that I was to assign to him. One day after work hours I had a friend stop over who use to live in the community she was dropping her children off with their father who lives here, there were going to their grandparents for a month for summer vacation. We went up to the pool, I had had a rum and coke before she got to my house. We talked for a little and decided to go see the kids up at the community pool before they left. Upon entering the pool gate I stated to the daughter(a lifeguard) of the pool manager that we were just coming in to see the kids. We proceeded in and after walking in there were two ladies that had asked if they could speak to me before I left about some issues in the community. I was off duty but I said yes but to give me about 10 minutes to say hello to my friends children. I among everyone was questioned if I had been drinking, I answered I had one drink after dinner. The daughter called her mother on the phone. 5 minutes later the mother (pool manager came up to the pool and embarrassed me and said that I was drunk and had to leave the pool. I could not believe it I had one drink prior definitely not drunk the two woman were waiting to talk to me and the pool manager telling me to leave. I went over and apologized to the women that I would like to address their issues but was being told to leave and the question was quickly presented anyway I told her I would look into the matter but I would have to get back to her. I told my friend lets go they are making me leave the pool. After getting outside the gate the I was stopped by another woman and proceeded to talk to her.. The cops came up the street..... The lady walked back in the pool area The cops proceeded to tell me they were called and told that there was a intoxicated woman in the pool area that refused to leave the pool did I know anything about it??? I said wow Vicky called the cops on me... I guess I am the one you are looking for... The officer could not believe his ears. He could clearly see that I was neither intoxicated or unruly... Nothing was written up by the cops they dismissed the whole situation and continued to talk business with me on another matter. I was upset. Then on Monday my manager came in and had me sign a document which I was disheartened and not feeling I should have to I did not break and of the rules. In confidence we spoke about the matter she said that the main office was making her have me sign this reprimand which was a 6 month probation period. I was told specifically that this was only between us that shouldn't even discuss it with the pool manager (her friend) she only knew that she was going to be talking to me about the situation. They would not know that I received any type of recourse except for the discussion. The next day I was asked by several tenants about the situation the story was so out of control... The 2 cops had to supposedly take me out arm and arm and that I was given 6 months of probation for it... I was so upset, the whole story had been misconstrued and confidentiality had been broken. Is this breach of privacy??? Defamation of character??? Before this the pool manager and maintenance man were on a rampage spreading lies around to begin with this hurt my feelings and caused a lot of questions... Last Month a soon to be ex-husband was causing some trouble in the neighborhood harassing other tenants about his wife's whereabouts and harassing phone calls to the office followed up by unannounced visits... The man was no longer a resident and the police were getting tired of dealing with the situation. I was instructed by my manager to send him a letter ..he had no physical address, I explained this to my manager and told her I could get it to him by sending it to his friend( boss) who worked out of his home. The fried was already aware of the issues between his wife and the man. He had been involved in a police issue previously with the husband so he could talk to the man sensibly. I sent the letter by fax asking the man to refrain from coming in the community any longer and harassing tenants and myself up at the office. I was terminated for several reasons retaliation, racism and breech of privacy for the letter sent to the man. Thank you for reading this ...any information will be helpful... My situation was clearly to start a defamation of character that started over a year ago by a schizophrenic paranoid 66 year old lady (now 67). I am now 63. To make a long story short, she was accusing me of "stalking" her among other things, all very obviously untrue to both the property and maintenance managers as well as my wife and others. I am very involved in our church, guitar playing and family activities to have time for such praddle. But there were enough other neighbors around that believed it that it affected the relationships. The end result after a year or so of this was that we were sent(after 7 years of tenancy) a letter of 30 day notice to quit (our rent being fully paid up, and still having and 8 months left on our lease). The "violation" of the lease was totally frivolous and I was offered a free defense by the Michigan Legal Defense League.

I don't know what your income status is, but if you are at or below the "poverty level", I would suggest you contact them to find out how to proceed.

Before contacting them however, our daughter called us just a few days after we were sent the notice to quit tenancy begging us to move back from Texas to Michigan with our 3 (10, 12, 14 year old) grand daughters! Bingo! New problem! Don't need small apartment anyway. Of course property manager doesn't know this, but he knows he is in for one heck of a legal battle. The phone call from my daughter is on a Sunday. I go Monday morning to the leasing company and approach the property manager and say, "um, Bud (fictitious name), do you still want us to move?" He says, "Yes". I say, "Well, you know this is going to put a heck of a strain on both my wife and myself who are in poor health, you know this is frivolous, and will also cause us a financial burden. Would you like to avoid the legal battle?" "How?" he asks. "Well, refund asap our deposit, and all of our June rent, and we will be out on July 4th as you have requested, without a court battle or eviction proceedings." To shorten this part, we received 2 checks on June 20th of this year, one for $495.00 for the deposit tenured in 2000 and one for $535.00 for rent tenured on June 1 of this year. He released us from the lease and promised to give us a good reference, in writing.

I would suggest you send a certified letter to your property manager explaining the unbearable circumstances and that you demand release from your lease, contact legal services in your community to see if they can assist you, and even consider filing suit against the leasing company if necessary to get out of your lease, including a refund of a month or two of back rent for pain and suffering. You are dealing with some very nutty neighbors, and I do not see any benefit in any kind of a slander suit. A cease and desist letter will accomplish nothing more than aggravating the situation more. I would not worry about any damage to your "reputation". These neighbors didn't know you before you moved in, so what "reputation" did they damage in the first place?" Going back over your post, it looks like you live in a small apartment, like a house apartment and not a complex, right? So it looks like a failure, a serious failure of disclosure on the part of the landlords. This doesn't sound like a leasing company at all now. For your sanity, refund of security deposit or not, you need to be willing to cut your losses and get the heck out of Dodge. We were lucky. We got out of Dodge with some damages to boot. If the "neighbor" is your only hope of a "job", then I can only guess that your "career" isn't nearly as influential as you think it is. If it is, then surely you can use that influence to a lot more advantage than you have. Maybe you ought to print these posts out and show the company you are trying to go to work for what is REALLY going on, and that you think you are being denied a job because of gossip and defamation of character. This is a chance to go to bat for yourself. In any case do everything you can to STAND UP for YOUR RIGHTS! I hope this helps.

Regarding your problem. May I first suggest you join with a user name. No one will bite you. Then I can share my experience and how I got out of my lease and got a refund of a months rent back (stayed for the month for free) and my deposit, before I moved out. You have rights too.

My husband and I recently moved in to a first floor coop apartment. Our mistake, apparently! We were under the impression the quality of people who live here was much higher than it actually is. Upon moving in, we met our neighbors from upstairs---and although the husband seemed nice, there was something very off about his wife. Over the next week, we couldn't sleep, couldn't relax, couldn't do anything in our own apartment---the woman was seemingly doing everything in her powers to make noise, and later admitted it as well. We asked the husband in a friendly manner one evening (while he was sitting outside alone) if he thinks there's anything he could do, and he said he'd try to keep it down. No more than 5 minutes later, the wife came downstairs with a vengeance and started yelling at us about our request, throwing her own problems in our face. To no surprise, she told us (for whatever reason) that social services had just been there that day. Anyway, we smoothed things over and soothed her a little, and eventually she left saying she'd try to be quieter and tell her son, too. She went upstairs and stomped her feet all night. Another month went by and we had put up with a LOT of noise at all hours of the day and night. One day the kid was jumping off their couch onto the floor with his friend, and things in our apartment literally shook. It felt like someone was jumping on our heads, so we knocked on their door and politely asked if she could please ask her son to stop jumping so much. She proceeded to scream at us and tell us how rude we're being by asking, etc. etc. She said some horrible things to us (reasons why we don't have children, etc.) and told us to be quiet, go back into our apartment, and shut the door. We left for a few hours and upon arriving home, she greeted us at our door and yelled. She yelled so loud at us that people stopped and stared at us. As if that wasn't embarrassing enough, she continued, only getting angrier and more horrible than before. We told her we're tolerating a lot more than him jumping off the furniture, she told us she's tolerating us telling her how to live. We went inside to cool off and calm down a bit. Over the next several days, we heard her telling neighbors about the situation, but of course it's her version with embellishments. That's not our style, and people here don't know us yet since we've really just moved in. Unfortunately for us, she's ruining our reputation. One neighbor she spoke with is the only neighbor I've met, who was setting me up with a job, which is now "on hold". I'm more than sure that what she's telling the neighbors is impacting our careers since we're in influential careers. I know it's a long-winded description of what's happened, but I'm hoping there's help somewhere. We're looking for a new place to live as of next week and are aiming to get our security deposit back from our landlord, who lived here prior to us moving in. What can we do legally in this situation? I have everything documented in my own notes, but nothing with security from our neighborhood (we didn't want to go that route and be too aggressive since we figured it would have negative repercussions since we're still living here). Any ideas??

When a person files a restraining order against you, is the restraining order (whether approved or dismissed) grounds for suit of defamation of character?

I would like to know if a previous client can file suit against a law firm who three years ago handled the case and now today I am finding out that the medical part which was supposed to be paid the Hospital from the Insurance Carrier has never been paid and I have been turned in to a collection agency and I have written statement from the attorney's office that all medical would be paid. This is false against my name which goes into the Credit Bureau.

my husband has a "girlfriend" that he says is just platonic yet he takes her out to dinner and goes over to her house for drinks and "small talk"..I admit that we don't have much in common anymore and I enjoy spending time with my best friend, shopping or watching a vcr movie, etc., than being around him...(he drinks a lot) he says that he doesn't know "what" kind of relationship I have with my best friend...he is insinuating that we have a lesbian relationship so he is justified in having a woman as his "friend"... I am so outraged by this accusation of his and his rationalization.. I am definitely not a lesbian and neither is my best friend. My question is if he continues to slander me (when we get a divorce) can I sue him for trying to ruin my reputation in a court as "slander"?

I am probably the first person to answer someone else here on this portion of wisegeek's forum. I am a victim of slander and gossip. Read up above. As a result, we were served with a 30 notice to quit, which we could win, if we chose to fight in court. The notice is due to expire July the 4th. The property manager of the complex we live in knows the "violation" is frivolous. We have lived here 7 years. For reasons I can not yet disclose, we have chosen not to fight, but rather negotiate. As a result, the p.m. of this complex, and the realty firm is a large firm, has agreed to a fair cash settlement to get us to move without a court battle. In a couple of days, with cash in hand, I will disclose more, and might offer more suggestions for you. In the meanwhile, I will probably pursue a slander suit against the party mentioned above, the small city and its police department, et al. I suggest you purchase the $20 online book before going any further, and see if there are any other books available that might help. I purchased the book and found it quite helpful. I thank God I found this site, and am glad I can offer you some help.

Awhile back, I was out in the garden behind our apartment building, pulling weeds. One of my neighbors had neglected to care for a number of tomato plants. Being the good guy that I try to be, the weeds were pulled and the plants were trimmed. I helped myself to a couple of green tomatoes, no bigger than a tennis ball. The next day, I went back out to finish weeding. As I went back to the building, the person who put in those plants had something to say about my efforts. Instead of a simple thank you, she had the nerve to call me a thief. Not only that but she spoke this in front of a number of tenants of the building. Not one person had the nerve to speak out concerning this. From that day forth, hardly any one of the fifty tenants have anything nice to say to me. I've lived here for fourteen years. I'm the anchor tenant and also was caretaker for the first year. Because of one person branding me a thief, life hasn't been the same. I can't begin to tell you the many insults and the gossip about me. I'm unable to move because of my financial problem and seeking damages for this has been very difficult. Is there anyone out there, reading this, who can offer some valuable advice about remedying this problem? After all, I pay hard earned money to live in this apartment building. I haven't harmed anyone by careless words or actions. Feel free to respond to this post or write me via email. Thanks much for your concern.

The couple that learned their lesson was the one I had the "heated discussion" with, the one that I "secretly" recorded. Fortunately, (I did read about recordings) I haven't let that info out. And he and his wife both apologized to the RN and myself. They have been very friendly ever since. Boy that has helped a lot. Their is victory out there folks. Just stand your ground and don't give up!

As an aside, the gossip went to the wrong couple, and they got carried away, much to their chagrin, and realized their mistake and apologized to us and another party that was offended as well. My former immediate supervisor fired me for the "not being a good fit" for the position. When I applied for unemployment the UI representative said that the reason that my former employer's HR department gave to them was that I broke safety policies. It's like night and day. How can I get them to retract this statement so that my name is cleared of this false accusation? I am afraid that this mixup in reasons may affect my chances at future places of employment. Any suggestions?

Help! We are having a terrible time in the very small once peaceful apartment complex in small town Michigan where we have lived for seven years. About 2 years ago, a 66 year old female moved in. I tried to befriend her, and all was well, until I broke her "rules".... anyway to make a long innocent story short, she has been spreading malicious rumors about me, and I cannot get a handle on them. It has caused problems with other neighbors, not all. (She is even claiming she has a restraining order against me, which is untrue!) I was hired by one RN neighbor to do cleaning (I am married, 62, on disability, and need the money) and her 3 neighbors are protesting. It is the RN's business whom she hires. I secretly just finished digitally recording a heated discussion between myself and one of the neighbors I thought would be more understanding. I got him to admit there are rumors, but nothing specific. I want to take this woman to court, and the others as witnesses and/or parties to the suit. She has money that can be discovered. I want to be vindicated. It could also end up being a suit against the realty company if they get involved somehow. Our lease is good through Feb of 2008. Neither one of us are in the best of health. Please offer ideas asap.

I have a male employee who has been working for me for over 2 weeks now. He went through a complete drug and physical exam about 1 month ago.

Today while driving the dump trailer hauling material for a cement company, he went into the office where the scale person who was busy talking to the secretary turned and asked him if he was okay. The driver answered yes I am okay. He was asked again and he again stated that he was fine and that nothng was wrong. He was told by this scale operator to park his truck since he was not going to drive anymore as he was under the suspicion of being under the influence of something. He was not allowed to drive and I had to take him to get a urine and drug test.

This man does not drink or smoke. He gets nervous around people sometimes. I asked if the scale operator was trained in detecting persons under the influence and the answer was no. I asked who was going to pay the driver and my company for having my truck parked for the next 4-5 days until the blood and urine tests came in to clear or point him out as being under. I was told that I was not going to get paid and that they were not responsible. They were concerened about this driver having an accident.

Like I said, he does not drink, smoke and much less do drugs. He is a clean driver.

My question is as follows:

What action or act can I take against this type of harassment just because a scale operator said so. Who is paying the driver for those days and how is he going to feed his family by being accused unjustly.

I know that if I take action, I will loose my truck company from any further work, retaliation. What action or act do I take to correct such wrong doing?

If you were accused of being called a thief, and it wasn't true. And that person went around the office saying indirect things about you such as people should know not to touch things that are not theirs, the next thing that goes missing from my desk im going to punch you in the face.. Would that be considered.Is that not defamation of character.

I dated a coworker for several months until I decided to break up with her. After I broke up with her she started to maliciously spread rumours about me at the workplace stating that I had physically abused her and that I had also attempted to murder her. I had no evidence to accuse her of slander other than the gossip of fellow coworkers. Eventually she submitted a two weeks notice stating that she was leaving because she had a restraining order against me. She put her signature on this document. I know for a fact there is no restraining order nor any type of police report or physical evidence of abuse. I haven't been fired from my job, but the embarrassment I have suffered is undeniable. Is there any type of legal action I can pursue considering my employer can provide a falsified statement with her signature on it?

I have been unfairly dismissed by a well known person who has been in the media since January. I have answered a letter in a particular newspaper where the correspondent has invited former employees to comment on his character. I concurred with all the negative adjectives used in that letter and displayed the truth about why I was fired. The well known person has implied that he will sue the newspaper if my letter is printed. Why would he sue the newspaper and not me? Your thoughts are welcomed.

I had applied for a position with a security guard business. The owner of my daycare went to the hiring manager of that business(which is in the same building) and told her that I had an active EPO against me after I complained to them that a teacher, who watches my child in the daycare, wasn't doing a good job taking care of my daughter.( This teacher had previously been removed from that classroom for similar complaints, but returned to the classroom without my knowledge.) My girlfriend and I had filed EPO's against each other and it was mutually dismissed a year ago. Also, at that time, I was told that I could never come to the daycare to see or pick up my daughter due to the filing of the EPO and it didn't matter whether it was dismissed or not. I later found out that that was not ever a policy. I have been deprived the visitation of my child for a year and possible a job. Is this grounds for a lawsuit? I feel that this was done maliciously and I am not one to file a frivolous lawsuit. Any insight on this would be greatly appreciated.

I am a former radio announcer. recently my name came up on a radio oriented website with libelous, slanderous comments. The comments implied I was fired from my last job on the basis that I allegedly had a child with a 16 year old girl, and I was called a statutory rapist. I have contacted the site to remove the information but have received no reply. I have also requested information on the origin of the posting and have the same response. What can I do to find out the who the poster is (I suspect a former co-worker) and would this be considered a a reason to file a suit against my former employer if my suspicions are correct?

Would you have grounds for a suit if an employer gave wrong information about the employment of a person to a new job seeking employment information. For example... you did not get along with your boss, so you decided to submit your resignation willingly. YOu go to get a new job and the new employer calls your old job seeking employment information and this boss says horrible things to the new employer that are 100% false, and you do not gain employment because of this wrong information?

my supervisor has a pesonal problem with me out of everybody on my shift she has her favorites also. but she's always watching my every move which makes me feel very uncomftable working. while im at work im depressed because because i feel the tension in the room she's racist, and she acts like i don't know my work or is a poor worker. and she keeps lying on me for no reason.

I think if your coworkers can provide evidence that their own work was diminished--e.g., your boss paid them less, they made fewer tips, or fewer of their articles were picked up--by what you published, even if it was true, they could sue you. I think they have to provide actual numbers in such a claim, though. That might be a significant barrier to filing such a claim. I'd be curious to know more about historical defamation of character cases.

I'm amazed. I always assumed that you could only get in trouble for saying things that weren't true. This means that if I publshed factual narratives about coworkers, they could potentially sue me? Anyone have any experience with this?
