What is Slander?

Slander is the spoken or transitory form of defamation of character, a legal term that refers to a falsehood presented as true which could harm the reputation of a person or entity. Slander also encompasses body gestures as in the case of sign language. If defamation of character is placed in a fixed form, as in the case of a sign, published paper, film or recording, it is considered libel. In short, slander is temporarily uttered or gesticulated, libel is published or otherwise fixed.

Slander is a tort, or civil law, meaning a civil lawsuit can be brought against someone who is accused of slander. In the United States certain facts must be established for someone to be found guilty of slander. Assuming there is proof that the defendant uttered the alleged statement, the statement must be overheard by someone other than the subject or other “privileged” parties. Slander must also clearly identify the party or entity, and the intent must be malicious.

Winning a defamation of character lawsuit can pay off in two types of compensation: general damages and special damages. General damages covers emotional trauma while special damages covers economic loss. In the case of a slander lawsuit proof of specific special damages might be required before general damages can be awarded. Unfortunately, special damages can be hard to prove.

Some types of slander, however, are considered “slanderous per se” and are automatically awarded general damages without proof of special damages. In this case the slander must do one of the following:

  • Declare the plaintiff unfit to perform his or her job adequately.
  • Allege criminal behavior on the part of the plaintiff.
  • Claim the plaintiff has an unsavory disease.
  • Make immoral sexual claims, especially about the virtue of a female plaintiff.

The more people that are party to a falsehood, the greater the potential for harm to the plaintiff. For this reason, libel cases generally award more damages than cases of slander, as libel reaches a greater audience. With the advent of the Internet, many types instantly published, worldwide communications have become fodder for libel cases. Online libel is sometimes referred to as cyberlibel.

I keep wondering why political candidates don't sue some of these non-profit political groups for libel over the malicious and totally untrue statements made in their commercials?

I know that political debate is protected free speech but at what point is there a line in the sand. After all, you can't yell fire in a crowded theater and that only effects a couple hundred people, but elections effect millions.

This man has spreading these rumors about me at work and now my coworkers are all now laughing at me. He supposedly furnished pictures of a woman's naked body and woman having sex claiming it's me. Please can you help? I have the neighbours from hell! When they moved in a year ago, they started the first week with the neighbours on the other side! She got their fence moved and her drive widened. Then she started with us. She wants the council to divide the communal garden we have out in front! Well, that's fine since she never cuts the grass anyway! I have been dealing with an individual who emailed a complaint against me as a fictitious prospective client. I was called into the office and it caused such discomfort that I had to resign from the job.

The same person has also told people malicious lies about me, making claims to enough people that I was not welcome to attend a function with others. It still continues as I have a ton of email messages concerning the accused fabrications. Is this slander and if so how can I slam the door on this individual to end it for good?

I should not have to block numbers every six months and screen calls as part of my life and should also not have to deal with the individual calling my girlfriend and raising issues with her.

@post 91: amy is actually wrong. If you had her tell you through text messages, email, or any other form of chatroom contact, you can use that as evidence. You can also get her computer used as evidence too.

My boss has been telling others that I am an idiot and denying that he said these things. I left the job and was asked by him to come back to work because he needed my help. I have been accused of stealing paperwork and an office key that were given to me at the start of an internship (un-paid). I returned these items to the front desk at the office. A month and a half later, I am charged with misdemeanor, larceny theft of the very items I had already returned. What do I do? I found out my nurse girlfriend of over six months and whom I treated like a queen was cheating on me the entire time with a 60 year old coworker doctor who is married.

I have written him a letter telling him what's been really going on and that I'm aware of his cheating. I don't think he knew about me or that she is just using him.I have written her a letter as well. I would like to write a letter to their department manager and HR, revealing his infidelity with his coworker, or maybe just share the personal letters I have written to each individual.

I don't have proof in hand but the evidence is plentiful if one were to look. (I think he may have even bought her a new car since she filed bankruptcy less than a year ago and doesn't make too much money.) She had even confessed to me that this was going on and I watched him come and go from her place.

Furthermore, I plan on disclosing this information to his wife in person. Since he's a doctor and I'm recently laid off and broke, I'm worried about the charges of libel and slander he might bring against me.

Last year, my department's assistant manager said to me "You are drugged. You want to go home? Can you work?" Didn't even say good afternoon. After he played around behind my back saying I was doing a bad job, my manager told me I was doing good among other coworkers.

One day my boss told me that and I told him the assistant manager is harassing me, telling me if I want to go work in another place like walmart or walgreens. He told me to speak to the general manager. I did and he told me that we will have a meeting. We haven't yet, but according to the law in Florida, it has to be in the next six months, but it hasn't happened. He still is making trouble for me and harassing me and discriminating against me for speaking Spanish. What can I do? How can I sue?

@anon247755: You need a lawyer, not a union rep, and not a union lawyer. You need someone whose only concern is you.

I don't know what the laws are in your state, but if you don't live in an at-will work state, you can (I think) sue the company for wrongful termination.

As far as charges against your co-worker, slander cases are next to impossible to win, but you might get him for something else. As I said: you need a lawyer, and one versed in employment law.

I got into a verbal altercation with a co-worker, and he eventually brought it to a physical nature where he pushed me backward, grabbed me by the shirt and threatened to hit me. When he let go, I walked away and never laid a finger on him.

I brought it to the attention of my managers and union reps. The problem is, he is lying by saying that I also was pushing him back. We are both now on suspension and likely to be fired from our jobs.

I know of three people who saw the whole altercation but refuse to admit what they saw, likely due it being a union issue.

Can my co-worker be sued for slander? And if I lose my job could I receive special damages compensation?

This person I had business with decided to spread it in the media that I used this credit card without his consent. However, it was over the phone and the person, in Atlantic City. I put him on speakerphone and everyone heard him giving permission to use his credit card. It was for an emergency. Now he tells the media that I stole his credit card. Is this slander or libel? Or defamation?

Everyone I associate with who knows my reputation as having a good moral character informed me I can sue for defamation. But I just want an outside opinion.

I went to an arby's about a month ago. It's so close to my home I have gone a couple times and have an idea about the employees who work there.

I'm in Portland, Oregon and the overweight population is not big, especially among females in their late teens and 20s. There is a girl who works there who is very overweight. One day she was not working.

A friend and I were the only ones in the arby's at the time and there were 10 plus employees including the manager present at the time, not including the overweight employee. Then everyone, including the manager, started seriously bad-mouthing this employee. I am overweight myself and it is difficult getting a job, then when you get there, you have to deal with that crap. They probably went on for 10-15 minutes about how fat she was and how she just needed to lose some weight. I thought it was very unprofessional and rude. I am totally put off to going there anymore or ever applying for work there.

@anon235982: Why won't any lawyers take your case? Because they usually only take cases they think they can win.

Here's the breakdown: First, the burden of proof is on the plaintiff (you). *You* would have to prove she had herpes and HPV while she was with you, that she *knew* she was infected, and insisted on unprotected sex.

Second: Your roommate would have to testify that she slept with him too, and that he had contracted these STDs from her, also. If she gave them to you, it stands to reason she gave them to him.

Third: You would have to get medical files that prove she was infected during the time you two were sleeping together. This is really tough to do, since medical records are confidential.

If she's been with other guys and you know she infected them too, then if you all went to an attorney, with your own medical records, you might have a case, since there would be a pattern of behavior, and her medical records could then be subpoenaed, assuming she knew she had the STDs and ever received medical treatment for them. Then, you have possible grounds for assault.

You can't just go to an attorney and say, "This chick gave me herpes. I want to sue her." You've got to have more proof. Any competent defense attorney would just say you already had herpes when you started dating her, or you got it after you broke up, or you were mad at her and made up the story after you broke up, and unless you had proof positive from your records, and hers, it's just he said/she said. It stinks, but there it is.

I really am sorry you're having to deal with this, but your best option is to see if any other ex-boyfriends are in the same situation as you are, and would be willing to pursue legal action.

The funniest thing is my ex was sleeping with many people while we were at college and gave me STDs. She would even creep down to my roommate's bedroom while I was sleeping and have sex with him and gave me herpes and hpv so I made fun of her and the cops called me from a private number and said I'm in danger of making terrorist threats. That was probably a fake call and someone was impersonating an officer. Isn't that a crime?

We can't assault people here, then how when we ask them if they have STDs and they say no and intentionally spread them, is that not malicious and assault and battery? I've talked to many lawyers and no one will uphold my case.

My daughter was fired from her job in oklahoma for stealing. They have no proof she says she did not do, would never do it, she loved her job. She was a waitress and going to college. They are not filing criminal charges but the reason she was given is that they know she stole money from the drawer but again they have nothing to prove that. Can she sue them for saying that? Can they legally tell future employers that she was fired for stealing?

I'm almost certain that my neighbor contacted SRS and gave them false statements. SRS showed up at my door for a report of a "dirty" home -- a home so dirty my children had to crawl over mounds of trash to move around.

When the SRS woman entered our home, she looked shocked that it was not anywhere close to the statement. She read the report to me and my wife, and gave us the date. I did put two trash bags on our front porch. This woman once falsely accused us of animal neglect as well. She called the police because our dog had no water. My wife and I were at work, the dog was taken care of -- he spilled his water bowl that day.

The funny thing is the officer showed up when I was getting the dog water and food when I got home. I could deal with that, but calling the SRS? That is going too far!

I also got a phone call from my former boss from her personal cell phone saying I could not call out to my previous job. She has told my sister that I will get a bad reference and that she is glad I'm gone.

This employer also told me two weeks ago that I am crazy. What can I or should I do to keep my name from being degraded? My work performance was outstanding. Any suggestions?

Yesterday, at Barnes & Noble where we go all the time, I just happened to be taking a lady for CT scans and while waiting, ran to the bookstore. I was with a mentally challenged, young woman who had cerebral palsy. She has lived with me for three years because of being raped many times over while staying at a center for the mentally challenged.

My husband and I met her 10 years ago at an inner city church for the poor. She was orphaned and had no family support. Once anyone met Nancy, you would fall in love with her. She is the most well liked person and known throughout the churches in Houston. Since she has been raped so many times, sometimes she will leak urine so I put a diaper on her and she hardly ever has it dirty, but just in case. You could tell visually she had a diaper on.

Well, first thing we do when we arrived at Barnes & Noble, I tell her to go to the bathroom and then she can choose some books to bring back to read. She can do things for short lengths of time and this is one of her great enjoyments. She was gone for a little longer, about 15 or 20 minutes and when she got to the table, I left to go get me some books. While I was gone, the manager came to her table and told her she stunk and would have to leave. He did it twice to her and she said she couldn't until I got back. I guess he thought she was alone.

When I went back to confront him, he said that his employees noticed she was spending a long time looking for books and said that she smelled bad. I asked him if he could let me speak to the employees. He then changed his story and said it was the people in the cafe. He went with me to the cafe, and I asked everyone -- about 30 people – and none said they thought or reported such a thing. One lady gave me her name who was about two feet from us (I could touch her shoulder while I was sitting) and that is how close we were sitting.

This Barnes & Noble is located in one of the wealthiest parts of Houston. I believe that he harassed her, defamed her, slandered her and broke many laws of protection for the disabled and female. Mentally challenged women are four to 10 times more likely to be raped by men than any other part of society. Experts report that it has become an epidemic and for this man to do this to her frightened her so much, I could see the fear on her face as I approached the cafe part of the book store.

I leave in a small village in New York. I recently learned their is a woman who claims my son has bullied her son. They go to the same school and are in Cub Scouts together. The only reason my wife and I were told we because I am the new Webelos Den Leader.

My son has never had a behavior problem in school and never had any reports for bullying. The mother has also referenced my son in a lawsuit she has against the school district. The underlying difficulty I see with many of the scenarios in these post is proving actual damages. In this country, anyone *can* sue just about anybody else for anything. Sometimes those lawsuits are summarily dismissed as groundless, sometimes they are settled out of court, and sometimes they go to a full trial.

If you believe someone else has slandered your reputation and caused serious harm, then by all means you have the right to pursue civil litigation. Don't expect to win thousands of dollars in punitive damages, however, and don't expect your problems to be solved overnight.

It hurts when people say things that are untrue about our character or our abilities or our reputation. It's only natural to want to defend ourselves against liars. However, there is a difference between true slander and what most people experience during the course of a heated argument or confrontation. I could tell a professional chef that the meal he prepared was terrible and he was a lousy cook, for example. Other patrons in the restaurant could hear the argument and know that I criticized his cooking skills. Yes, in a sense I have slandered him. But other people may disagree with my assessment. Their meals were delicious and the chef is very talented. They'll still come in for dinner every night, and still recommend the restaurant to their friends.

I may have slandered the chef because I was angry about the quality of my own meal, but I haven't caused him or the restaurant much in the way of actual damage. He could sue me for slander if he chose to, but most likely he'd realize that one angry customer's outburst doesn't mean the restaurant will fail as a direct result. Proving slander to the satisfaction of a court usually requires a lot more malice aforethought.

On the other hand, if I had told everyone in the restaurant that the chef had AIDS or spit on their food, then the chef might have a stronger case against me in court. My slanderous comments, based on untruths, might have caused others to boycott his restaurant or have it shut down by the local health department.

I am need a question to be answered. My now ex-boyfriend works for a controlling couple who is telling him who he can and can't be with. He's 25 and I'm 26. Everything was going great until a few months ago when he was told by the couple to stay away from me as they claim that I'm a trouble maker and hooked up with my nephew going out and creating serious trouble getting arrested.

I live with my elderly grandmother and don't have the time to be out getting into trouble and the only time I've dealt with the law was when I had been pulled over due to a tail or headlight being out. So could this be a slander problem?

I played doctor with some kids in my neighborhood when I was 12 years old. One of the kids was younger, about six. Now, 40 years later, people still accuse me of being a child molester, even though there has never been another incident in my life.

i called the police because i realized that my apartment was robbed. there was a combination lock on the door. i gave the cleaning woman the combination lock for the key, as she was scheduled to clean after i had left to go out of the area. she did not answer my numerous phone calls and i had someone come there the date and time she was scheduled to clean, left a check for her, which was not taken.

After reporting this incident to the police, they suggested she call me. she did call and denied the whole story that she never came into clean as i asked her not to after not having received a return call from her. i did not file a police report.

can she sue me for slander? (her husband is a cop and she saying that i ruined her reputation.

@Anon124016: I am not a lawyer, but she can say whatever she wants. Doesn't mean anyone is really going to listen to her.

Those cashiers know she's nuts. They've worked there long enough to know who's crazy and who isn't. But they have to be nice to her and humor her because she's a big spender.

Unless I miss my guess, her main mode of attack, so to speak, is to say nasty things about you. You're probably not the first she's done this to. Really, the last thing she wants is to involve the law, either through a civil or criminal court. I'd be willing to bet she's had a run in or two with the police. Arrest records are public information. Go to the records clerk at the police station and ask if she's ever been arrested. If she has, you know what you're dealing with.

@amypollick: I forgot to ask you one important thing. This woman is a bit off, but does she have any grounds to try to falsely accuse me of scamming her?

As I have said, I never told her to withdraw money, I never asked her for money and I sent in writing how much she had gifted to me, but insisted on paying it back to her, including the birthday money.

I did this in writing. I am so angry that she is discussing this with anyone up there who will listen, but does she have any grounds to cause me any further pain? thanks. this is a great site.

I can't go to a different casino, because this one comps me free money for food and gambling every day until Feb. However, I will do just as you say: money order, and in front of those cashiers who are breaking the rules and spreading gossip about me.

She is a mean woman to blame me for her gambling losses. I did ask her who she blamed before she met me! Thanks again!

@anon123887: Get the woman a money order for the cash and have two people witness you giving it to her. Make a copy of both sides of the money order before you give it to her. Then, have the witnesses sign a statement saying they saw you give her the money -- and get it notarized. That way, she can't say you didn't give her the money.

This does not really meet the definition of slander. It meets the definition of a mean old woman who is ticked off because you won and she lost a bundle. The truth really doesn't matter in this case.

Pay the money and find another casino you like. It's not worth it having to deal with this woman. And please, for your peace of mind, choose your friends more carefully. People get weird when money is involved.

I frequent a casino almost every day. I don't have a job, but I was really lucky a few months back, and have won over 14,000 up at the casino, on random jackpots. This enabled me to get a higher ranking comp card, and I get free $20 a day to play with now. This was over a seven month period, that I won.

I met an older woman, who is considered an MVP, meaning she gambles over 40K in a three month period. We sort of hit it off, and she was amazed of how I was able to win, starting with practically no money at all and building it up to wonderful winnings. So we started gambling side by side, and had lots of fun while she was winning.

One day, I told her to play a machine and it had a random jackpot set to go off at anytime, for $900.

She did, and got a bonus round, for almost $500, and the random jackpot hit as i said it would. The woman spends a lot of money there, usually three-five hundred a day. So, I was sitting next to her, and she put a $100 bill in my machine, and said for telling her to use that machine, she gave me two hundred more, a gift I now wish I had not taken.

I would have given it all back, but didn't have the luck she did and lost it so I told her i was uncomfortable about taking it and would pay her back when I won again. So over a couple of more months, she gave me about $80 more, $40 of which was supposed to be a birthday gift.

Last week, she blew almost $2,500 in a three day period, on a game I'd won big on before. All of a sudden, she lambasted me,and accused me of making her play that machine, when in fact I was playing it and she took it over, hoping to win a huge jackpot on it herself. So when she accused me of scamming somehow, I wrote her an email, and sent her my address, phone number, full name, and also let her know I'd sent her three fantastic character references I'd been using for job interviews, to show I was a nice person.

Next thing i know, she is spreading it all over the casino where I play, that I am a crook and not to be trusted. I offered to repay her the $400 she'd gifted to me, anyway, because I didn't want it. And i put this in writing.

So now what do i do? I have heard that some of the cashiers are talking about me really badly and they were always nice to me, but the woman has lots of money and tips them big, and they side with her, not even asking what the truth is.

I am being totally slandered. I have decided to just let it slide for now, but what will happen? If the management steps in and makes me leave, I will sue her.

I recently have had retaliatory acts and a case filed against me by the former defendant in a small claims case I won against him, and following an appeals case I won.

During this time he hired three attorneys, two of which he fired and one he hired back. Anyway, the two attorneys he enlisted have harassed me since I won the case. One of them hit me on one occasion and the other threatened to take me to court for libel, slander and defamation. When the lawyer hit me I was in a location where others couldn't see anything, so I ran into the bailiff who was beyond elderly and I couldn't get him to move fast enough to catch the attorney who took off like a bat out of hell. I reported him to the bar association.

Now they filed a defamation case against me because of some information I shared with neighbors about the defendant's criminal history which I got online on a court site. But prior to that, they had asked a judge for a restraining order that this man lied to acquire it.

Although most people might have gone after this guy for what he did, I refused to get into an altercation with him but he lied and said I had been on his property when I hadn't. This man kicked me out on christmas eve because I told him he was wrong to throw his partner out which he was doing that same night. I liked them both, and honestly felt like he was being a drama queen. I left that night with a check he gave me to pay me part of the money he owed me for work I had completed, and a promise from him that I could return anytime I wished to get my belongings. Both were lies. He changed the locks and kept my belongings -- everything I owned. He refused to return countless calls and visits to the house so I took him to court and won my case. I even won the appeal he filed and the judge increased the award from the first case.

In the appeal, his attorney friends helped him and I still won. Now they are filing this frivolous case sending me letters saying, "were not going to let you play the games you played in small claims," adding, "This is going to be different because now we're in the big leagues not small claims" which I found threatening because they demanded I call them or face the court.

I refused to call them, first because of the restraining order two because I felt that would jeopardize my safety and privacy. I filed a response, or answer, as you call it, and a defamation case against him because his new partner was e-mailing people telling them I steal and sue people for a living, and that I will take them for everything they have.

This was my only lawsuit I have ever filed and the thing about being a thief is not true. In fact it's rather peculiar since that's exactly why I sued him. He stole my belongings. And the court agreed with me. I recently filed a lien and thank god because he put his house up for sale, and I got my money.

Last week, after finding out I was given the money by escrow, he wrote an e-mail to me saying he wasn't done with me yet, and asking if I spent it all yet. Typical.

I can't afford an attorney, nor do I have one living with me like he does. By the way, the attorney who hit me was the one living with him. As for the case they filed, it's based on a printout I made of a recent drug bust that this person was arrested for. Apparently after I moved out, he started selling drugs. This info is on a public court site anyone can access.

Lastly, he is a hermit. In the five months I lived and worked on his property he only left the house three times. Three times in five months. So you can see he is far from famous. He also wasn't working when I met him, when I lived with him, nor now. He was and is living off a settlement he got in a previous relationship.

So he can't prove he's been defamed if he's neither famous or known. He claims to be an artist, but I've never seen him sell a piece of art and neither has anyone else so he can't prove monetary loss, but these attorneys are shady and the one that hit me lives with him, so he will have them on his case and i have to defend myself.

Should i worry? Should I be scared that they know some maneuver motion or tactic I'm not expecting? I want this guy out of my life and want to forget I ever met him, but he insists on pursuing this retaliation. Is there something else I can do?

there was a protective order placed against me by a woman who lives across the street. she is good friends with my husband's ex- and the mother of his child.

She had stated that my two children was threatening her daughter, but when my husband called the school, the principal told him there were seven girls who were all fighting, the officer told her she didn't file it right that it was just on me, so there were no problems.

i told my girls if they said anything to her child i would go to jail, but her daughter is going to school telling my kids that no matter what i do they are going to be without me because I'm going to jail, and they are very upset every day when coming home from school.

She also stated my daughter was threatening to kill her child. my child said she was going to punch the little girl because she has been making fun of my child and the school will not do anything about it.

I have a holiday home in pembroke. While staying there for a few days, i went shopping, and saw my daughter-in-law coming out of premier inn with her boyfriend (she and my son are separated). Now my son has received a letter from her solicitor stating our client was astonished to see when she left the hotel that your mother had made her way to the hotel and was photographing our client and the friend. They asked what my purpose was. I was at Wilkinsons shopping and the hotel is next door. I have no photos and did not have a camera with me at the time.

After studying art at university, I had become unwell due to slanderous comments about my so called behavior. I was dating an israeli architecture student at the time and living in halls. My flatmate was studying sculpture but was also the irish karate champion, and at 26 stone she was no mean feat.

My boyfriend thought it funny to tell her that I had made comments about her sexuality and her weight when I had done no such thing. She then started saying things about me to people that weren't true and even verbally attacking me in front of people saying i was evil. She left halls after that.

I split from my boyfriend after one night he tried to force himself into my room and would not leave my flat. Luckily, there were others there at the time and they all told them to get lost.

I had to move halls, and I have to say things did not get much better either, because of other various incidents in which i was not to blame either.

As a result my health deteriorated and i ended up so unwell i was not allowed back to uni the following year to finish my degree. As a result, my life from then on has been very hard. Whenever i have tried to study again, it seems to have been a repeat pattern of what happened the time before but involving other slanderous people and situations.

I've just put it down to jealousy. People obviously want what you have, but if they carry on like that then maybe they never will. The trick is not to stoop to their level, no matter how they try to bring you down.

This is an update on the posting about the charity shop: I have now heard that he is telling everyone i asked about his tackle. when in fact he was always talking about himself and explaining everything about his life and past.

I got a call from the police late last night to say they want me to go in next week about the incident but neither they nor my employer has told me what the allegations are and the police would tell me nothing but to say come in and we will tell you why.

I am worried sick about what he has said and have to sit at home for a week and wait. I suffer from hypertension and anxiety and do not know how i am going to get through this.

I have just been suspended from work. I work for a furniture shop charity. A man rang up to get some furniture picked up and we spoke for awhile to arrange it all.

Later, he said he wanted to be a volunteer. He mentioned finally that he was actually a transgender and said he would come in as a woman. Eventually he worked with me and became disruptive and argumentative, trying to take over and turn the staff against me and stopped them working by always wanting to sit and chat. He/She became disruptive and i dreaded going into work. I spoke to the manager of another charity shop where he worked one morning and she said he tried to talk about the volunteers and cause trouble there.

I had difficulty at first to think of him as a woman, as he had told me he was a man. He looked and spoke like a man in every way and i did have trouble saying she and with her name as he had given me his name as a man originally so he rolled his eyes when at first i got confused.

Last week he came in and i had loads to do. he argued and was insolent at everything i said and asked her to do. He came in dressed outrageously and inappropriately for the job, with a huge wig on. So he started arguing and said i smelled and i said i was going out the back as i was upset and he said 'piss off then.'

He then followed me out in a threatening way and said he was reporting me to head office as someone had told him i had an issue with his sexuality and gender. I said it was because i thought he was a man originally so it did take me a while to get used to it. When i came back in he was at the front door with another volunteer talking and eventually he left. That volunteer was the only witness and she is his best friend who has known him/her for years.

I told my boss all about it but the next thing i know is my manager came in and suspended me and said she had made serious accusations against me. She said don't worry, she would have to formally interview me and would try to do it all quickly. I had to leave straight away.

I am not in any way prejudiced against anyone and have been through hundreds of volunteers over five years and nothing like this has ever happened.

He said he was not gay but fancied woman and often got into sexual things when all the lady volunteers were in, which i found inappropriate. He sat in my office and held court with them all and i heard him causing trouble against me from the start. He also said the volunteers had come to him saying he should run the shop as he would be better than me.

It was impossible when he was in to get anyone to work as he kept taking them out for a cigarette and girly chats.

He invited them all to his house for dinner but not me and made me feel he was against me. He also said to me the van driver was laughing at him when he saw him in the job center which the van driver denies.

He has split the shop and volunteers against me so i hope they will give a fair interview to my boss about me. I haven't done anything against his sexual orientation. In fact, i don't care anything about it or what he does. I just wanted to run my shop well and get the work done.

I wasn't told by my boss what the allegations are so i haven't got a clue what he has said. I am now at home shocked and not knowing what to do. She even asked me to write a letter soon to the NHS to say he had integrated into society as a woman so he could get funding for an operation, and i said of course i would.

He also asked me on several occasions to feel her bust so i could see how they could grow with hormones.

I did find it hard because he has a deep voice originally on the phone, looks like a man and acts like a woman in drag, putting lots of red lipstick on and big wigs which don't look right in the shop. But i don't really worry about that. It was the attitude and divisiveness which caused a bad atmosphere.

He also tried to split me with my assistant manager by being her best friend, hugging her and taking her always outside for girly chats and cigarettes and he was trying to get them all together to go shopping and all walk down the street together holding hands and arms.

I am now suspended for talking up, otherwise he would take over the whole shop. I have never discriminated in any way but i am confused and feel i have been bullied.

i have worked for a company for five years and just received a text message from a coworker stating they know i am using drugs. this is false.

i was supposed to go into the hospital to treat my lyme disease properly and they thought i needed the time to go to rehab! they hurt me so badly that i quit. is this slander or defamation of character? for the past year i hated going into work and became very depressed that i couldn't eat or sleep.

I met a girl online. We never met in person. After a few weeks I discovered that she was dishonest in many ways and might possibly have psychological issues, if not at least anger issues and I believe her to be extremely immature for her age (32).

We got in an argument, she said we were no longer friends and then hung up on me. It happened before and she cooled off and called me back, but I no longer wish to talk to her, so I called and left her a voice message to lose my number. I was respectful in doing so, by stating that I didn't think we were a good match- even as friends- so don't bother calling me back later when she cools off.

Then she started calling my number repeatedly, but I didn't answer. She finally left a message saying that she was going to call the state, because I am drawing unemployment at the moment, to tell them I am working for my brother-in-law under the table, which is a lie- and easily proven false.

She also told me she was going to call my school to say I am "cheating the system" (whatever that means) to try and get me thrown out of school. She also says she is going to sue me for defamation, which is hilarious because I haven't slandered her at all, haven't even said a word about her to anyone- aside from this description of my situation, which doesn't mention her name or anything.

Now, I am totally not worried about her threats, because I am completely on the level and have nothing to hide. The truth will be easily proven because I can account for everything that I do- records, etc. Nothing to worry about as for her threats.

However, if this girl continues to conspire against me- who knows if she will get someone to believe her lies for things that nobody can be protected against? I am pretty sure I could already sue her, if necessary (but I'd rather she just leave me alone) because I think there would be a record of her conversations to whoever she calls, which I could use as evidence against her.

But, whats the point? She has nothing but her misery, and frankly, I have had enough of it.

I am hoping she is just acting childish and making empty threats- but if she does act on them, is it a slam dunk for me? I doubt either place would believe her, but if they do how can I sue her when I don't even have the money for a lawyer? Is there a public attorney that would charge her for the fees when she loses?

I helped out a friend of mine about a year ago. She went and lived with another friend of mine and while she was living with him i got her some stuff.

Well, after she moved out of my friend's house, she told a few friends of mine whom i have not talked to for awhile, things like I lost my children because when she was staying with me i was selling drugs to teens.

When i ran into my friend whom she told this to, he was like, sorry to hear about your kids and i was dumb founded so i asked what's wrong with them and he told me what he heard. When i found out she told others about this i did not know what to do.

I don't care if people say things about me, but my kids are my world and i don't stand for that. is there anything i can do about that?

In fact I work at a company. I had to apply for some refund at an organization for which i needed two letters to be signed by my manager. I asked him to sign one letter and the other i didn't. The next day, I gave my letter of demission. He says it is not ethical and in the whole company, he did meetings and told everyone that I, Miss X did this and that.

But I explained to him that the letter that he signed is of no use without the other one. Even though he used my name as reference in the entire company to discuss on what is ethical and not. He thinks I did this for some personal gain. But I think he should have at least try to see how I can use the letter for personal gain.

This letter has no meaning without the other. Does he have the right to use my name like this in the whole company? I feel humiliated. I feel like I will go into depression. He should have asked me before using my name before those 50 people. Am I right?

i was on an airsoft paintball website, and i asked what the cover charge was for, for an event that was free like six times before. Instead of answering my question, it was deleted. So i posted the same question. it was deleted even faster.

So i put a Smiley face(an afraid face to be exact) and it was deleted and I was banned after doing so. Then seven minutes later i received an e-mail, saying that if i ask again i will be banned. Seven minutes after, i was banned from this website.

this started a heated argument between me and one of the owners, then the other owners stepped in. I bowed out of the argument saying i would never cross their path again, if they leave me and my airsoft webpage alone. They are continuing to talk smack about me and the airsoft forum i helped form.

i know this because i keep getting banned from airsoft websites all over the USA. Today i logged into another airsoft forum and posted some information about my website, looking to draw more players. It was deleted and my account was banned.

these guys are running around slandering my name and the name of my airsoft forum. Do i have a slander case?

My daughter's boyfriend's mother broke them up a few days ago. She told her son to do this because she does not like my daughter. Being the mama's boy that he is, even though he's 22, he went along with that.

well he called my daughter anyway because he loves her and wants to work this out, but his mother went crazy and had his cell phone number changed because she thinks my daughter is calling her son.

She then sent me text messages saying horrible things about my daughter, such as she hates living in my bubble, she needs to work, she is a liar, she needs help before it's too late and that she is abusive to her precious son.

This has made my daughter physically sick and she even had to be taken from college by ambulance to the hospital because the stress just made her collapse.

Anon77276: No, it technically isn't slander, because the person obviously genuinely believes she is telling the truth. If she knew it was a lie to start with, it would be actionable, but since she's convinced it's true, there's not a lawsuit there. The person doing the talking has to *know* what he or she is saying is a lie to start with.

I'd ask my manager to come with me to the store and ask the manager at bergners if you could view the tapes you're supposedly on, since a bergners employee made the accusation. The bergners manager needs to know an employee of theirs is saying these kinds of things, perhaps without much proof, except what she *thinks* she's seen.

I think you need to see those videotapes and the employee with the big mouth needs to be reprimanded by *her* manager.

I work at a hair salon and it was my day off but i stopped in to say hi to my other stylists. After i left my manager called me and asked me if i knew the girl whose hair she was doing. i said i never seen her before in my life. she then told me the girl whose hair she was doing told her that she works at bergners store and i am always coming in there and stealing from her store.

I haven't stolen anything in my life and i have a bergners charge card and have spent good money in that store. Now let me remind you: she's telling this to my manager, so my manager tells her that some people get me confused with a lot of people all the time.

I work for a bad company. Anyway, when I was a new employee the current manager, a person clearly out of control, threatened to do bodily harm to me if I didn't get out of there that day. I was a two week old employee.

She never lost her job at that point and from then on I had to grin and bear her bad behavior for another month until she was moved to another location. Recently it was rumored that she was coming back to my location. I told the senior manager that I could not work with her and refreshed his memory in regards to her behavior. My mother-in-law passed away February 2009. She battled with dementia. My husband took care of his mother and father for approximately 18 years, even the years they were not ill. They went on many many vacations with us and we ate Sunday dinner at their house each Sunday.

After my father-in-law passed my husband was a companion to his mom. We took care of my husband's father daily, with my husband giving him insulin shots and checking his blood sugar. These grandparents loved our children and also loved the other grandchildren as well. To make a long story short, my mother in law's dementia was in the stage where she needed constant care and my husband's brothers and sister, who has some resentment because my husband was always so close to his mother and father and resentment toward me for the relationship I had with them, accused my husband of taking a huge amount of money from his mother.

His mother, before her mind went, told him that anytime he needed something that she would help him out because we had done so much for them. Maybe my husband took it a little far when we got into some deep financial problems, but I was not aware of it at all! I never knew they accused him of that for about a year and along with that, they accused me of taking lots of money out of her ATM and using her credit card at a department store.

Before my mother in law passed, the siblings changed my husband's power of attorney to the sister. Now they had their mother's permission but she was legally not able to make any kind of decision due to her health. The family made a huge stink out of this and it got out to the public also. We live in a small town.

The siblings sold their mother's home and my husband did not receive his 1/4. He's the type who doesn't want to cause commotion. Not only did they withhold what he was to get from the home, he didn't get anything he was supposed to receive from his mother and only a handful of things out of the house.

This has ripped me to pieces. At one time, it consumed my life. I am seeing a therapist and at least I don't cry all the time now. I almost feel ashamed to go to family gatherings and have no reason to feel that way. I have never taken even an extra slice of cheese when we cooked out hamburgers.

I wrote a letter and sent it to all of them. My next step is to go to my mother-in-law's sisters and brothers to let them hear my side of the story. Heck, I was tried and hung without a jury. I never got to speak. It hurts. I love that lady with all my heart and still do.

Two of the three of my husband's siblings talk with my husband now. We don't have family gatherings at all with them even at Christmas. What I can't understand is that two of them have made some sort of peace with my husband and can carry a decent conservation, but won't even bat an eye at me. My husband admitted to some wrongdoing and I did nothing!

I thought about an attorney, but they came back and said they would get us for taking advantage of the elderly. I don't know what to do about this situation. It's killing me. I have been married to my husband for 10 years. i had a previous relationship that ended horribly. he even got custody of my son and i haven't had contact with him or my son for almost eight years. they lived in indiana and moved to illinois about four months ago, even to the same county where I live.

I have been involved in a situation for about three years now. I work for a medical clinic. During the early part of my second year, it was found out that the NP's wife was stealing our narcotics. The NP and attending physician were made aware. All was taken care of.

About two months later, the NP was terminated. I chose to accompany him to a new practice which he opened in the same community. This is a population of about 2,500. All of a sudden accusations are being made that I'm a big drug user and I'm hiding things the NP is doing. All of this is totally false. People on the hospital board, which is where NP and my former employer have started an investigation with the police. There are things being done such as the administrator writing letters to vendors stating that I have been purchasing supplies and charging them to their account. This too is a big lie.

I guess I just want to know what I might can do to stop the nonsense!! Very frustrated! There is a person that was told by one of the board members that I was a drug addict and I'm almost certain he might would testify on my behalf.

My ex-boss recently called my new boss and accused me of contacting the employees of my old job and stealing them to come to the new company I work at.

I feel he did this in malice attempting to cause issues with my new employer. Three people have left the company since I have and the two that did come to my company applied online without my knowledge.

I was sexually discriminated against by an employee of a company that I conducted business with. I informed the company of the problem and they fired the employee but to this day he still harasses me and I hired a lawyer to sue them because of fear of my safety, and that person knowing all my personal information. I can't go out always being in fear that I might run into him. A letter was written to the company president that we were suing for damages and they were responsible for what their employee did. They rejected it, stating unless I can prove he did it to others, I did not have a case. My safety is still in jeopardy, so I have friends who are my supporters and wrote reviews online to their customer service practices. Well today I received a call from their lawyer and said I will be sued for malicious slander. Why would I be sued? I told them what about my safety? I have held the same job for fifteen years. a good friend of mine who also works at the same facility is getting ready to retire, and I have shown interest in obtaining her supervisory position. There is a relatively new woman in that department who is also interested in this position. She got together with two other women in that department went to the head of HR and accused me of stealing, the allegations were proven false, but subsequently the rumors have now circulated throughout the entire facility. Do I have a case for slander. Some of my duties have been diminished as a result of these rumors.

I am webmaster for a local dog kennel and am very good friends with the owner. Recently she fell victim to a scammer. A previous customer of hers called and stated that the animal she had purchased was ran over by car. The owner of the kennel, being softhearted, agreed to sell the woman a new puppy at a greatly reduced rate of approximately half of the animal's asking price. She even offered to let the woman come get the dog and only pay half of what would be owed on the puppy with the agreement that the woman would pay her the rest of the money by a certain date. The woman took the animal and has since not paid the remainder of the agreed upon price. The owner of the kennel has called her on two separate occasions and extended the payment due date but the woman still has not paid her. The owner of the kennel wishes to place this story, including the customer's name and address, on her website to warn other kennel owners about the woman's possible ill intentions. The owner has hard evidence that the agreement was made and breeched by the woman. I wanted to know if a libel case could be brought against the kennel owner for posting the customer's information.

I randomly punched his name on the computer just to see what came up... and I found out that he is engaged to get married! I confronted him, and he said he would tell the truth to this girl. I told him I was going to call her because of all his lies. I contacted this girl and she said she didn't believe me. This girl's mother called me and accused me of being a stalker. I was honest with everything and I even have the call log and I saved text messages of everything that can prove my statements(through the years). I am being called all these names and I am innocent. I didn't even know about this girl! My name and reputation is being slandered. I am in school for a career (pyschology), and I want the honest truth out in the open, so that my reputationcan be seen to all that I am truthful and honest.

I feel that I am being slandered, and this is causing emotional pain for me. I want my reputation to be clean and the record to be set straight. It is the guy who was guilty and is has been lying to me and the other girl.

I have a family member who was recently arrested for statutory rape. Since his arrest, his name has been broadcast over a local radio station two days in a row. The second day was with another person accused of statutory rape. If he is proven not guilty of charges, does he have a case against law enforcement and the radio station for slandering his name?

My former land lady went to our office,for confrontation, I was absent that day, and he found my brother who is also studying there. She get mad coz we moved to another home. She was accusing me that i took her curtain and umbrella without any evidence and witness. And in my part, i did not take those things, she been saying words against me, inside our office, and people have heard what she said. The guard, my office mate, and some of the students. a manager at a former employer has informed my current employer untruths. I was employed as a bartender and also as head of security at a bar/restaurant, a manager at that restaurant has informed my current employer (where I am employed as a bartender) that I never bartended there and was "just a bouncer". Records at my former employer would list my position as "bartender" and I can produce countless witnesses that I served while bartending. This statement by a former manager put the facts that I listed on my application for my current employer in question. Is this grounds for a slander suit?

The situation is quite complicated and I hope I can make it clear.

To start my partner has a son with an ex partner, who unfortunately took access away after their separation, we have been to court and restored access, but now she has decided to breach the court order and stop access, in this long and unnecessary (5yr) battle my partner age 29 had to undergo a major surgery which has saved his life but unfortunately caused some disabilities making him unable to work and do some, what we would call simple tasks, unaided this has caused depression and embarrassment.

Basically the ex wishes to make my partner pay- in my opinion it has little or nothing to do with their son. Neighbours have reported to the police about her and her husband acting suspiciously around our property while we were out. veiled threats have been made but it is the texts that coincide with this issue of accusing my partner of Benefit Fraud which has been investigated and the benefit fraud officer agreed that after a thorough investigation my partner was and is not working and was not able to in his current circumstances, this was the end of it as we thought but unfortunately she’s spreading around that he has committed benefit fraud amongst other vicious rumours.

This is causing real upset to my partner who cannot defend himself very well due to lack of self confidence, I feel that arguing back just gives her more satisfaction but I wondered legally if there is anything we can do to stop this, please.

We are currently taking her to court for restoration of the previous court order but I was unsure as to whether our solicitor can do anything until the present case is settled can you help please?

I am a female residing with two other females in a single family home. One of the neighbor's, a male, use to befriend us but we broke it off with this neighbor due to his illicit behavior toward us and for showing an illicit photo of himself showing himself nude. Our association with this man stopped immediately. Since then, he has spoken with other male neighbor's with their family against us. Now the male neighbor's in the neighborhood are taunting us with verbal threat's they are going to take care of us. Our other next door neighbor is a criminal and is perhaps still dealing in drugs from his house. He doesn't like us because we are law enforcement types. A few houses away from ours there is a law enforcement type male that is listening to their statements and is including himself in their hate towards us. Now, that law enforcement type male has indicated to the other males, he would take care of us and told them to not to worry. What are we to do? Now my employer is involved in this matter because a neighbor made a compliant about us. Being a female law enforcement type person prevents us from having any civil rights. We have gone to several local authorities and no help was offered to us, just advise to make reports to the police about any incidences. No case and I'll probably be spoken sternly by my employer about these incidents. What are we to do? Get a lawyer?

I was wondering if I may have a case of defamation or slander on my neighbor? She has gone to my landlord and made false statements in writing along with other neighbors about me having my children medicated just so I can collect SSI. My children are not medicated, only my daughter, and also she does not receive SSI. It has come to my attention that this person said that he thinks I am racist to two other people. When he was asked how he came to that conclusion, he said that it was because of a tattoo that I have on my triceps that reads "brown pride". The person who asked told him that he has worked with me and he never got that perception or vibe that I came across as a racist. The individual who made the comment then said, that anyone that has a tattoo like that must be a racist. What can I do to clear my name?

I think my Son-In-Law is being slandered by a co-worker of mine (his mother-in-law) for no reason. He drives a truck for a very popular food distributor. He is usually gone 1-2 nights per week out of state. This co-worker of mine has only met my son-in-law once. She has been making comments that he is lying about what he is doing, and making suggestions that my daughter is being cheated on. That this company would not need over the road driver. Let me state he brings home nice paychecks for someone not working!! She knows nothing about the company does not work for them and has not reason to implicate this. I am not sure how to stop this, my boss always says just ignore her. Well that is not helping as she is making false statements about my family. I am concerned that this will cause a major upset to my pregnant daughter, and her husband who is a fine man. She even said he probably does not have a license to drive the truck. Which is false. He is a very good family man. Please, let me know how I may stop this type of talk about my family. They do not even know this person. Thanks!

How do I go about legally telling people around my block that my 4 year old nephew was shown or flashed inappropriate things from a next door neighbor? He does have a record and "other" things that were before Megan's Law. Also an ongoing investigation with this. There are other children in the area and an elementary school up the hill from us! How can I warn people with out hurting myself?

My fiancee and his brother own joint properties they inherited when their mom passed away six years ago. Recently my fiancee has decided that he wishes to split the estate and move on with his life. They currently live together in their home and have split the utilities and my fiancee has been paying the property tax for the past six years.

Well, the brother has started telling everyone that will listen to him that my fiancee is a freeloading bum who is living off his "dime" and that he owes him 50+ thousand dollars because he is paying all of the bills for the house. Funny things is he has never worked a job in his life and is living off of the money he inherited.

My question, since the brother is talking to neighbors, a Realtor that HE hired to sale other properties, a public lawyer and a multitude of family members, does my fiancee have any sort of case in a slander suit?

I think I have a case involving slander. Someone that lives on our block received a phone call from a individual propositioning sex over the phone. This person that lives on my block is stating that the person was me and says that it is a fact. After urging this person to investigate the situation. This person is refusing and stating its not needed because its a fact. Others on my block are finding out because of more statements from the individual accusing me and there is emotional turmoil in my life because of these statements which is leading to severe depression not only to me but my family. This person making accusations is also a law enforcement officer. Any help on this matter would be greatly appreciated.
